I used to sponsor my wife as my fiancée n she got deny in 2014 at USA embassy in Cambodia. After that, I sponsor her as my wife (I-130) n she will get interview again on this September.

I need u guys help for one question. On 2014, they asked my fiancée (now is my wife) if I was wit her in the interview n she answered no because I didn't have vacation to go to Cambodia, but actually at that time, I was in Cambodia. The reason I didn't go to interview wit her because my dad was really sick n he didn't want anyone go away from him because he could die at anytime. My dad passed away 3 days later after my fiancée got deny.

My wife will get interview again on this september. What I suppose to answer if they asked me or my wife that why at that time u were in Cambodia n u said u were not. Why didn't u answer u were in Cambodia take care of your dad instead of answering that u didn't have vacation to come to Cambodia. Please help me because I'm afraid they will ask us those questions.

Thanks

Don't lie. That's the lesson. Why did she get denied? That's the question.

Now the advice: I'm very familiar with Cambodia. An unstable, corrupt government makes everyone suspicious of everything. And because of the sexual and economic exploitation factor, it's tough to get visas for Cambodian fiancee or spouse. Go to the interview and be prepared to explain anything and everything. Be honest. Good luck!

P.S. I love the people of Cambodia and enjoyed working/traveling there. However, the future is very bleak. Hope you two can get out and live in U.S. Be safe!

Do you have reason to believe they know she was lying? If not, it is unlikely to come up, I think.

You might be over thinking this. But as previously said, don't lie and stick to your story. I assume the first time your intention was to work and not to take care of your dad. Your story does not sound fishy at all from my perspective. Good luck with your interview.

Okay well you werent at the interviewn but you were in Cambodia. So she lied, but there was zero need to do so.

Regardless of the Cambodian government corruption, the US government doesnt like being lied to. Take this seriously and answer TRUTHFULLY.

OK, she lied, but was it material misrepresentation? Likely not, as she was denied for the visa, anyway.

Do not lie, but also do not volunteer information.

I don't really get what r u saying

Lying to a CO is always bad, and it makes them suspicious and may deny you. However, if you lie to the extent that it is "material missrepresentation" (a big lie which could have caused the visa to be denied by itself), then that can lead to a ban, so that she may not get a visa for many years. The previous reply says, and I agree, that this was not material missrep- ie, even if the current CO knows about it, while it will make them suspicious of what your wife says now, it doesn't mean she will be automatically denied.

Just be with your wife at the interview and be truthful with any answer. At this embassy, you must attend the interview to have a good chance of passing interview.. She failed interview last time because may be you weren't there. Not attending the interview is a no no at this embassy. Someone might have given you wrong advice. Take it from someone who has been through K-1 the CR-1 before same like you at this embassy, one of the toughest to pass. Might be toughest. They deny visa without any reason at all. It's been like that for years! They may not ask that question again. They will definitely ask how many times you visited and during which visit you got engaged and which visit you got married. The more you visited, chance of passing interview gets better. Good luck

Thanks for yr advice. Due to my dad was very sick n he could die at anytime n he didn't want anyone went away from him, that was the reason we lied. At that time, I didn't have plan to go either because I didn't have vacation. Since my dad was really sick, I used Family Leave from my workplace to go to Cambodia. If they ask that question, I will show them my dad's death certificate n tell them the reason why. Yeah, I will go to interview wit her. Since I know her til Now, I visited her 6 times already. During those visiting, we travelled outside Cambodia 3 times.

I don't know your case details. How many times did you visit her before applying K-1? If it was first time then most of the time it's denial at this embassy no matter how much evidence you have or how many times you visited later on.You should be fine this time around. Make copies of your passport and her passports with visa stamped matching visiting other countries. They looked at our passports with visa stamps matching visiting other countries 2nd time around. It was very easy 2nd time. I would imagine it will be easy for you too. Just to let you know by the 2nd time interview, I visited 8 times, traveled outside Cambodia with wife to multiple countries at least 5 times. It was a quick and easy approval once CO saw I visited 8 times and matching visa stamps on both of our passports to different countries. Good luck
