Taxes filing for AOS sponsor

Hello,

I am going to apply for AOS but I have some issues in filling forms:
- In the affidavit of support (I-864) for my spouse (the sponsor); we have to submit the tax return transcripts in the past 3 years. In fact my spouse got recently a full time job and never filed taxes because she was a student and worked only in part time jobs with low income. How would we address that?

Just include a statement saying that for which ever years, she was a student and wasn't legally required to file taxes.

I only had to file last year, the prior two I hadn't worked.

Mine looked like this, omitting my name of course

STATEMENT REGARDING FORM I-864 PART 6 ITEM 18-20

I, <FIRST NAME> <LAST NAME>, have not included tax returns for the years 2013 and 2014 for the following reasons:

-- in the tax year 2014 my income was $0.00 and according to IRS guidelines I was not required to file a return .
-- in the tax year 2013 my income was $0.00 and according to IRS guidelines I was not required to file a return .



I, <FIRST NAME> <MIDDLE NAME> <LAST NAME>, certify under penalty of perjury under the laws of the United States that the information I have provided in this statement is true and correct.

Only the latest return is required.

They do ask to write down the income for the last 3 years.

If she wasn't required to file, she should write a statement about it.

Just check the instructions for the i864 at uscis.Gov

Because she was working on part time jobs, she was earning some money.

If we select that she was not required to file taxes. We should provide evidence for it. What kind of evidence would show that her income was less than the minimum amount required for filing?

It's usually pretty obvious if they made enough, but you could print this out and send it along with the statement: http://www.efile.com/tax/do-i-need-to-file-a-tax-return/

A single person under the age of 65 doesn't have to legally file unless they make more than 10000$. If she was self employed though, she'd have to file if she made more than 400$.
