I married an Iranian optical/nuclear energy grid engineer in April 2015 under the believe his feelings were sincere for me. After marriage, he refused to consummate the marriage and his entire personality changed. He became very abusive which escalated into physical abuse. He did not even live with me for months at a time. He had secret bank accounts, late night calls from various women, and disappeared for hours and even days at a time. I have never met his friends or family and he shut down his facebook as soon as we started dating and has never publicly acknowledged me. This is only scratching the surface of his sketchy behavior.

Ultimately, he returned to my state in February to retrieve his physical green card which had come in the mail which was also the weekend I was diagnosed with cancer. That weekend he hit me causing an eye injury that left me with a scar. Since then, he completely disappeared and refused to even tell me the STATE he was in. After that, I didn't hear a word from him for 2 months despite the fact he returned to my apartment complex to retrieve his car one month later and my door was 100 feet away, he had a key, and I was going through chemo.

Eventually I went to the police for the physical abuse (I had photos) and the magistrate filed a court summons. He missed his court date so I assume there is a bench warrant. My father and I wrote a long letter to immigration including photos of my injuries, a longer description of his bad behavior, more evidence of infidelity, evidence of my good faith in the marriage (adding him to my benefit programs at work), etc. and concerns about my husband's occupation and missing time. It also says that I will NOT be signing any I-175 for him.

We also copied the senators in my state. The senior senator then kindly helped me and sent a letter to USCIS. They added his "concerns" and my letter to my husband's a-file. They could not confirm nor deny an investigation but said it would be reviewed any time he sought further immigration benefits.

Last week I received a package from him that contained MY PASSPORT, SOCIAL SECURITY CARD AND BIRTH CERTIFICATE. I had no idea he had taken them. It was frightening. I also now have an email from him where he admits he has not consummated the marriage. I have a lawyer who believes I can get an annulment based on fraud.

His will need to petition for removal of conditions in September 2017. I am assuming this will be denied since we have done a pretty good job of pre-empting this with the letter (it is extremely detailed, my information here does not do it justice), the information in the A-file, and the upcoming annulment. If he does NOT get the permanent green card, can an employer sponsor him? What happens next?

I am sorry this happened to you.

I say divorce him and move on. His immigration status is his problem now, not yours.

I can't really comment on his chances if he files I-751 on his own, it sounds he didn't really live with you most of the time. He'd have to prove bona fide marriage with evidence of co-habitation and co-mingling of finances to be approved for it.

As for the letter you wrote to USCIS, they may or may not take it into account. Lots of estranged (ex-)spouses write such letters.

I do understand that in your case your not just trying to get back at him, but like I said USCIS gets these letters all the time, I'm not sure they always take them seriously.

You are still on the hook for the I 864.

I assume if he can not get his 10 year GC he probably will wait for Amnesty, there are millions like him.

An employer could seek to sponsor him.
