I have started a divorce in the court and a protection order as well, My husband came here last year and since then been blackmailing and threatening me. My question is this that I don't want the sponsor (cousin) to be involved in this matter, My husband says that he will make sure the sponsor gets dragged into this case as well, Is it possible I can write a letter to the NVC and let them know that I have applied for a divorce in the court and also let them know that the sponsor doesn't want anything to do with this? Will the sponosr have to write a letter to NVC stating that these 2 people are divorcing so he isn't my husbands sponsor anymore? Please help.

This is why its such a big deal to be a joint sponsor. If your husband chooses to make a ton of trouble its possible for thr us government to sue thr joint sponsor. Its unlikely but possible.

Also once your husband's case went to the consulate or embassy, the NVC was no longer involved. Once your husband arrived in the USA the DOS was no longer involved. The only US government section that has anything on his case now is the USCIS.

Have you filed for AOS? I thought the sponsor can still pull the sponsorship before AOS.

IR1/CR1 do not file for adjustment of status.

OP does not have a date of entry to the USA, but if it was anytime after 10/23/2014 then the husband has a 10 year green card not 2 year so ROC isn't even their goal.

OP said her husband came last year, according her timeline even their CC at NVC was after their second anniversary, so the husband has a 10-year GC. Edited by EM_Vandaveer

OP, first he would have to qualify for means tested benefits which is not an easy task. Some states have restrictions that require 5 years of residency before an applicant can qualify for the benefit.

Second, the state would need to have some means to check the applicant against a database that shows the existence of a sponsor. Some states have no process nor means to do this. I live in one of those states.

Finally, even if the state does approve benefits for a recent immigrant and does have a means to check for a sponsor, they still need to pursue the claim against the sponsor. From what I have researched, this isn't done very often. Part of the decision to pursue the claim against a sponsor relies on the threshold of the claims. A single man is going to qualify for a lot less means tested benefits than say a pregnant mother with children. It's a matter of scale.

Your cousin is probably okay.

EDIT: All that said, immigration sponsorship is still a serious matter and should not be taken lightly.

Plus even if all that happened, you are the primary sponsor. If the government wanted repayment (extremely unlikely) they would go after you first. Your cousin/joint sponsor would only get involved if you refused to pay first.
