Hi

My brother in-law has a priority date of March 2011, I notice on the August NVC visa Bulletin that the "APPLICATION FINAL ACTION DATES FOR

FAMILY-SPONSORED PREFERENCE CASES. has a priority date for F2b of Jan 8, 2010, but the box below "DATES FOR FILING FAMILY-SPONSORED

VISA APPLICATIONS" has a date of February 8 2011.

What is the difference.

When can I start completing the Notice of Agent and application.

Any help would be greatly appreciated.

dates for filing is when NVC starts asking you to fill forms, pay and submit documents

final action is when you can get a visa.

 

Got LPR status through family in Feb 2017
travelled back to Nigeria in Aug 2017, got married
file i130 for wife and daughter in January 2018
Case transferred from CSC to NSC in July 2019
got RFE in Oct 2019.

next: waiting anxiously for the mail...

Agreed with post above. If you BiL has a priority date earlier than noted in the bulletin, and currently in the US, he can use Table B, he will still have to wait until his priority date is current for a visa to be granted. If he's outside the US, he'll have to use Table A, and wait until contacted by NVC.

If you BiL has a priority date earlier than noted in the bulletin, and currently in the US, he can use Table B, he will still have to wait until his priority date is current for a visa to be granted. If he's outside the US, he'll have to use Table A, and wait until contacted by NVC.

No. If he's in the US and wants to do Adjustment of Status, whether he can file I-485 is based on which table USCIS uses, which currently is Table A, final action dates (but has been Table B in some months in the past; it's impossible to tell which they will use in a future month). If he's outside the US and is going to go through Consular Processing, NVC should contact him around the time in Table B, date for filing, but since this contact is not initiated by him, there is nothing he can do but wait anyway.

Hi, so do you mean that I have to wait 9 months from now even if my case is complete today.

My priority date is October 2010.

I sent my documents to NVC on 17 June 2016 and I expect case complete any time. They had communicated that I would get a response in 30days but still waiting.

The current visa bulletin for table A for F2b of Jan 8, 2010 but table below is February 8 2011.

No. If he's in the US and wants to do Adjustment of Status, whether he can file I-485 is based on which table USCIS uses, which currently is Table A, final action dates (but has been Table B in some months in the past; it's impossible to tell which they will use in a future month). If he's outside the US and is going to go through Consular Processing, NVC should contact him around the time in Table B, date for filing, but since this contact is not initiated by him, there is nothing he can do but wait anyway.

I know whichever table he uses he'll still have to wait for NVC to contact him, once his PD is current and visa available.

I was under the impression, if you're in the US and you have a date earlier than the cutoff date in Table B, you can send in documents - once you've received notification from NVC, I had a friend who did this - submitted docs, paid fees, but she still has to wait for her PD to be current.

My priority date is October 2010.

I sent my documents to NVC on 17 June 2016 and I expect case complete any time. They had communicated that I would get a response in 30days but still waiting.

The current visa bulletin for table A for F2b of Jan 8, 2010 but table below is February 8 2011.

You have to wait until your priority date is current in the visa bulletin, and there is a visa number available to you, so yes - even if your case is current at NVC until the Table A in the bulletin reaches Oct2010, you'll have to wait.

I'm 21Oct2010. Until the date for F2b is after that, say 25Oct2010 or 15Nov2010, I'll have to wait.

By the time your date is current, NVC will send you the medical and date for your interview, and your package will be at your home country embassy.

When you say case complete, have all your fees been paid as well as submission of all docs from sponsor and the visa application completed? 30 days is in business days. You can keep checking the case status online or calling, after those days have passed.

Yes I paid all the fees and submitted docs for sponsor as well. I initially submitted on 15th April 2016. Then nvc responded on 16th May 2016 that some information was missing/incorrect. This was corrected and I resubmitted on 17th June 2016. They received the updated information and promised to respond in 30 days. So I gues we waiting for case complete if all is fine. We are 3 sons and a daughter of petitioner. Thanks for the response. I gues we have to wait.
