Mistake on affidavit of support and interview is in 13 days

Hi everyone,

I found a small mistake on the form I-864 of my husband. He's only the primary sponsor because he is the petitioner, but his dad is our joint sponsor since my husband is currently living with me in my home country. The joint sponsor form I-864 is correct, I checked many times. The mistake is on the income (page 5, part 6) and the individual current annual income (item # 2) is correct, however, the current annual household income is higher by mistake and we sent it wrong. The problem was the currency exchange rate that we were using, we corrected one field but forgot the other.

Is this going to cause any delay in our process? Should I bring it out immediately at the interview?

I am bringing the I-864 with the mistake because it is the one we sent to NVC, but I'm also bringing the corrected version of the I-864 form.

When you said you are bringing the corrected version, do you mean you got a new updated i864 from the joint sponsor or you just corrected on that old form? As long as you have the updated i864 from your joint sponsor, you should be fine.

The income on the I-864 should be the amount reported to the IRS.

Yes, my husband earn in Brazilian reais because he lives here. He is not the joint sponsor. The I-864 from the joint sponsor is correct. My husband is the primary sponsor because he is the petitioner and his I-864 is the one with the mistake.

He reported his current income in the I-864 and it's different from the tax return income (in the tax return his income is 0, because all his income in Brazil is taxed in Brazil and tax return formulas make it zero), but we explained the difference in the tax return income and the reported income in the I-864. Note that we are not using his income to sponsor me and that is the reason we have a joint sponsor.

I think a lot of people are making a mistake here for Part 6 Item 2. This is your CURRENT income which you THINK YOU'LL EARN in the current year. There is no where to get this number except your BEST GUESS. This is copied from the I-864 instructions: "Enter your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided.

You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income."

I am aware of that. However, if you had no change on your job and is making about the same amount, a good guess would be your previous tax return.

Thanks for your reply but the amount itself is not my main concern. I'm concerned about the differences in part 2 and part 15 (since part 15 should be the sum of the specified lines) and we clearly made a mistake.

I am only wondering if they already entered the form in the system and by bringing the corrected form would take the case to administrative processing and delay the issue of my visa.

So you think we should put 0 in part 6 item 2 (current income)? His tax return says 0. However, when we submitted the I-864 we put the current income (not zero) and attached an explanation of why the discrepancy on tax return and current income. Because if we think about it, he already had an income this year because he is working so current income is obviously not zero. When we read the instructions for the form, is not 100% clear what to put on that item number.

For us it doesn't make any difference because we are not using his income to qualify, since we have a joint sponsor whose income is more than enough.

I am just thinking of bringing many different I-864 to the interview, one with the mistake (but that we sent to nvc), another one with current income corrected, and another one with zero income. Since we are not 100% sure.

What worked for us was to put 0 in I864, and attach work contract that starts after we move which shows sufficient income. London was fine with that (and so was NVC, no RFEs)
