Transgender woman arrested for voyeurism at Ammon Target

AMMON — An Idaho Falls man who police say identifies as transgender was arrested Tuesday afternoon after deputies say he took photos of a woman in a fitting room in Target.

Sean Patrick Smith, 46, who also goes by Shauna Patricia Smith, was booked into the Bonneville County Jail on one felony count of voyeurism.

Bonneville County Sgt. Bryan Lovell says deputies were called to a disturbance at Target on 25th East just after 5 p.m. Monday.

A woman told them a man, dressed in women’s clothing, had entered a fitting room in the women’s clothing section of the store. Deputies say the suspect was seen taking photos of a woman in a stall next to him while she was changing.

“The woman was begging for help as she chased the man out the door,” a witness inside the store, who asked not to be named, tells EastIdahoNews.com. “She kept saying she wanted those pictures deleted.”

Deputies interviewed Smith and “the defendant eventually admitted to me that she had made videos in the past of women undressing. The defendant told (the detective) that she makes these videos for the ‘same reason men go online to look at pornography,'” documents state.

According to the affidavit, Smith told the detective “she finds the video sexually gratifying” and when the deputy looked at the camera roll on Smith’s iPhone, he “observed a video of a young adult female undressing in a changing room at what appear to be Target. The defendant admitted to me that this video was recorded at Target

Transgender persons have been going in and out of bathroom stalls and dressing rooms for as long as I can remember. The key here is lawful behaviour while in these locations. Voyeurism, sex act, sexual assault etc is the action that is against the law.

I'll make it simple for you.

There are coats and people wear them in public.

The act of wearing a coat in public is not against the law.

Opening your coat while naked and displaying your 'goods' to another person in public is against the law.

So what keeps a person such as NB pointed out from trying this? I have heard that if someone comes out and identifies as a women or man even if they are genetically the other gender, we have to allow it. Now if they commit another act such as this pervert did in Idaho (and no, they are not a pervert because they may be transgendered, they are a pervert because of the picture taking) they can be arrested and potentially prosecuted. However, if they just go into the opposite bathroom or locker room and don't do anything else (no photos, no overt sexual acts, etc.) how do we stop that?

Exactly. They just don't get it. Most of us no problem with a tyranny quietly using a woman's public restroom

The problem is going to be the non bi gender. It opens up men, Horny teenagers, old pervs like us, whoever free access to just wonder into female locker rooms etc.

I thought we all beat this dead horse in the other bathroom bill thread, in which it was pretty clearly explained that there is no law that prevents NB from entering the women's restroom or dressing room - and there are many scenarios why a man may enter a woman's room etc. It's what his intent is there, that is the question.

It is no different than a man entering a men's room and committing a lewd act, or a woman entering a woman's room and committing a lewd act. The act is the problem, not the gender.

It gives the perverts legal access to carry out their deeds . They can sit in a pool locker room all day long watching young children shower and there is nothing anyone can do ... All he has to say is " I felt like a woman that day judge "
