Still did not get the last pay check!

Hi everybody, i have a simple question , i quit my job 12 days ago, 10 days ago i sent my manager like asked my address to send me the last pay check, i still didn't receive any check? is this normal?

How often do you get paid? Has a pay cycle ended?

For example, if you only get paid once a month, you'll probably have to wait until the end of the month. If you usually get paid on the 15th, you'll have to wait until then.

So to answer your question....yes it can be normal.

I would keep in mind that the manager didn't just cut and send a check that day, they wouldn't have done anything until they submitted it with their normal payroll, whenever they do that. When you quit the business is under no obligation to rush your final pay check to you. 10/12 days ago also would have been just before/after the 4th of July holiday, so that may have also delayed it some depending on the pay schedule.

Seems normal to me.

Are you in California? Your info says San Diego. If you are in California, you should be aware that the state has very strict laws about when your employer should pay you when you leave your job. If you gave at least 72 hours (3 days) notice to the company, they MUST pay you on your last day. There are limited exceptions to this rule, relating to whether there is a good faith dispute about how much is owed to you. It does not matter that you quit in the middle of a pay cycle. You have to be paid on your final day. There are penalties that accrue for failure to pay wages. The penalties are on top of whatever wages are owing.

If you are eligible, you can file a claim with the Division of Labor Standards Enforcement or sue your former employer. There is an excellent overview of how the system works here: http://www.dir.ca.gov/dlse/faq_waitingtimepenalty.htm

Bear in mind that if you did not give at least 72 hours notice, there are slightly different requirements. You may want to consult with a wage and hour attorney in your area since this can be complicated, and you might have other claims of which you are not yet aware (rest and meal breaks; overtime pay). Many attorneys will do a no-cost phone consultation to determine whether you have a viable claim.

Personally, I'd call the company and tell them that I am aware of waiting time penalties in California, and that sending my wages immediately was in everybody's interest. ;)

Hi, i just received the pay check today, i was too much confused about the situation, i dont know why i received this check after 17 days from quitting my job !!!!!!

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
