Hi, I recently entered the US through SEA port of entry.

The CBP officer told me and my husband that he's giving us a waiver to get the 10 year GC instead of the 2-year card since we're only 2 months away from our 2nd year anniversary. He told us to just call and make an appointment when we reach our anniversary to get the 10-year LPR card.

Is it normal for CBP officers to give waivers?

Has anyone experienced the same?

Oh and it has been almost two months and i still don't have my greencard (I woner if they're waiting for us to make the appointment?

I don't think that's possible.

If you enter before your 2nd wedding anniversary, you'll receive a 2-year (conditional) GC.

I dont know why EM is the only one who has responded yet but I can assure you - you were given mis information. Maybe cause you came in by Sea? Or maybe the guy was new. I cant imagine the guy was kidding because thats an awful joke...

" An intending immigrant becomes a lawful permanent resident once the immigrant visa and accompanying paperwork is reviewed and endorsed by a CBP Officer. "

There is no waiver. Never heard of one and just to be sure I googled around and cant find anything to support this story...The CBP just do not have that authority. The only way would be for them to alter documents or wait to endorse your paperwork- which they would NOT do as a courtesy. They would lose their job.

Please follow the standard instructions for how to obtain your 2yr card as soon as possible.

Do you have an I-551 stamp in your passport? The only possibility I can think of is that the officer granted you "delayed inspection", which means you weren't actually admitted into the US and won't be until you have the appointment with USCIS. If you have the I-551 stamp, it seems like the officer made a mistake.

The only possibility I can think of is that the officer granted you "delayed inspection", which means you weren't actually admitted into the US and won't be until you have the appointment with USCIS. If you have the I-551 stamp, it seems like the officer made a mistake.

If this was the case and she was given delayed inspection, it would not be USCIS but a CBP Deferred Inspection site that she needs to go to.

There is no I-551 stamp. There is a regular stamp that is placed beside the visa to endorse it. The date on that stamp is the date you were admitted as an LPR and that date determines if you have a 2 or 10 year card.

The CBP are notorious for not having a clue immigration wise. They told me it would be 8 months for my green card. Another told me to file ROC at 6 months not 3. <_< And yet another said Oh you weren't allowed to visit during the process... and I replied but I mentioned who I was visiting and we were in the process, they said. oh well that's alright then. :rolleyes:

Hi, Never heard about it being done that way. When I was at the interview at the American embassy in Stockholm though, they informed me that since we were only a few days away from celebrating our 2nd anniversary, they could wait for that date to pass before they did the final decision. Of course I said "yes" and so I received a 10 year GC instead of a conditional. After I entered the US border it took about 2-3 weeks for the GC and the SSN to arrive. If you haven't received the GC by now you should probably call them whether you will receive the conditional or the LPR to make sure everything is okay... And why not wait until the 2nd anniversary, as it is coming up any day now and the CBP officer actually instructed you to do that, just in case :rolleyes: .

I got the regular stamp on my passport. I got so confused when the officer told us that we just make the call on our 2nd anniv that's why I've decided to post my case/questions here to be enlightened.

Good to hear you have the regular stamp in your passport so there are no worries there. It is probably like other people already wrote, the CBP officers don't always know everything and sometimes they might misinform people. If I was you though, I would still make a call and ask for the GC (and SSN?) if you haven't received it yet. Good Luck with everything :goofy: !
