I-140 RFE & EAD Processing

Hello,

I-485/I-140 filed concurrently on June 15th, along with EAD/AP.

Biometrics scheduled July 27th. At time of filing I didn't have an experience letter from previous employer that corresponds to experience listed on PERM.

Lawyer suggested we file without and reply when they likely ask for RFE. But looking online initial requests for evidence restart the 90 day window for EAD, although the website is not clear if this only applies to the EAD application itself or all concurrently filed applications.

My work authorization expires October 21st, so if any RFE resets the 90 day window we need to do something now.

Would it be possible to apply for premium processing on the I-140 and submit the required experience letter with it?

Thanks,

Vagn
