Hi Arken i have been following your post since 2 days and seems that you can help me with some questions. I have filed the i 130 petition for my spouse and i just paid the AOS fees. The friend who is helping me with the sponsorship thing is in nepal right now. So i cant get the documents from her. I didnt work in 2013 and my 2014 and 2015 income level is too low than the poverty level. For 2016 i make just enough than the poverty level. Will i be able to sponsor my spouse or do i need a co sponsor? Please help me .

By rule, you can sponsor just by yourself but with your income history and marginal level income for this year, you might be asked to have a joint sponsor. But if you have noone but ur fren who is in Nepal at present to be a joint sponsor, i suggest you go ahead by yourself with evidences of current income. If you don't get any checklist, you are good.

By rule, you can sponsor just by yourself but with your income history and marginal level income for this year, you might be asked to have a joint sponsor. But if you have noone but ur fren who is in Nepal at present to be a joint sponsor, i suggest you go ahead by yourself with evidences of current income. If you don't get any checklist, you are good.

My wife just got issued her visa and here's my experience with sponsors: Here in China, they would not accept ANY sponsors or our assets that's in China. Even when the level of our assets were more then 5 x the poverty level. They only accepted a sponsor who's currently in the US and making enough money.

One thing that I read suggested that you could include a letter with your I-864 telling them your plans for the future. Solid plans that will meet the poverty level. For example, you're saying you barely made the poverty level in 2016. Write a letter (only if it's true) that you will be working in that company for a long time and the income will continue to stay or increase in the foreseeable future. Perhaps even get a signed statement from your boss saying something similar.

Of course, every country is different so they MAY accept your friend's co-sponsor from overseas but I really doubt it since it's pretty much impossible to enforce if it ever came down to it, unless he's a US citizen living abroad but you did not disclose that information.

Thank you for your reply torbocommpro. Can i ask you one question, i have some saving in my account but i dont know if it is enough to proof the assests or no. If it is compared with 2015 income then definitely i cant reach it. But if my saving account is compared with 2016 income then it is enough according to th instruction. I am just confuse now is it compared with 2015 income or 2016 income?

Provide whatever you have, it won't hurt. Print out everything in your checking, savings, 2nd car, whatever you can think of that you can immediately convert into cash. Also, when you include assets, it has to be 5 x the amount you're short of the poverty level. So say you're short $5k vs the poverty level, and have $10k that can covert into cash. That's not going to be enough. You must show that you have at least $25k that can convert into cash.

However, this really depends on the embassy. In my case, they did not accept ANYTHING other then a US sponsor that has a current job and meets the poverty level. We presented over $200k in assets (in China) and they didn't even want to look at it. The stupid thing is, the I-864 forms include a place where you can input your assets AND the intended immigrant's assets. It was not accepted here in China. So it really depends on the embassy.

So to be safe, I would make an appointment with the embassy and just go there and ask if you have the time. If not, just bring everything you possibility can and let them decide.
