Really I dont understand how people are advising to get married and then do a K1 visa. As far as I know that is a manipulation of the system and is fraudulent, isnt it

Who is advising this route?

OP- Why are you mentioning "gay"? Are you concerned you are going to be discriminated against because of this?

It is not illegal to immigrate on the basis of marriage or engagement. If you are in a relationship, you can marry your boyfriend or girlfriend and apply for immigration benefits. There is no shame not illegality to it. Why do you think differently?

OP- Why are you mentioning "gay"? Are you concerned you are going to be discriminated against because of this?

I think because only recently were immigration benefits extended to same sex couples. :)

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Who has done that?

You either come in October and DO NOT GET MARRIED and then file for K1. Or you come in October get married and return to your home country and then file for the spousal visa. Unless you've already planned everything for the wedding I would recommend just going with the K1 since it's faster. Otherwise you'll be waiting to be together for at least a year. It all depends on what is best for you guys. Please read the guides for more information.

hi i have a question i have read an article that says overstay is forgiven for a usc spouse what does it mean so even i overstay the immigration will forgiven me and give me a chancr to stay permanently in the usa

Are you currently in the US and married to a USC, and the two of you are planning on taking up permanent residence in the US?

If it isn't difficult, it isn't worth it.

That is fraud. You can NOT enter with the intent to stay! You will be denied at the border.

He should file for a fiancé visa for you.

If it isn't difficult, it isn't worth it.

Yes, you have to leave and as stated you cannot enter with the intent to immigrate with a non-immigrant visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
