we recieved a notice of denial today, as a result of failing to submit requested documented evidence for form I-72 to support our application.

The thing is, we went for our final interview last July, and were told that my husband had to have another medical exam, and supply an affidavit of support as we hadn't made enough to support ourselves within that fiscal year.

We did both getting my parents to provide proof of income, and getting the neccessary medical within a week and sent the evidence, believeing what we were told that pending a pass from the FBI, we would be getting his green card.

The letter states that we have to file a motion to resubmit the application which costs another $385 within 30 days. We are really devestated by this, and are wondering what has happened.

I would definetly be making an infopass bringing along photocopy/originals of what you had been asked to submit after your interview to prove that you had submitted these long ago. Did you use a return receipt or certified mail when you sent it back to them? You could use these things as additional proof.

You might be best off simply submitting a new I-485, no motion required.

My AOS was denied and i went throgh motion to reopen but they denied it as well.i also paid 500$ attorney fee plus 325$ motion fee.But i recommend you reapply sor AOS and dont go for motion bcs you should have very strong reason inorder they reconsider ur motion and also it takes afew months till they give a reply to u.

Can I ask why your AOS was denied. Did they lose your paperwork as well?

I can't believe this is happening. Eight months of waiting thinking that the only thing we were waiting for was the FBI check and now this...I feel so defeated right now. The wierd thing is when David went to our local INS branch to pick up his advanced parole document the woman told him that they had all the paperwork and were waiting for the FBI check. Why would she have said that if there was an RFE still pending on our application? Surely she would have told him his AOS couldn't go any further with the requested documents still missing. And why did it take over 5 months past the due date for them to tell us our AOS application had been denied? It just doesn't make sense. They gave us 12 weeks to gather the required documents...if the postal service did lose it, then why didn't they send us this letter right after the 12 weeks were up instead of notifying us 5 whole months later! David is at the post office right now trying to get some documentation that the envelope was delivered. Hopefully he'll come home with some good news. I don't know what else to do.

I just want to thank you guys for all your support and advice. I don't know how I we would have gotten this far without this great community.

On interview date the officer act like they have lost my vaccination document which was with my fiance package from embassy.and i thought that form is the only thing i should resend,so i did that,and they denied it bcs vaccination was not complete even in that form.however after denial i went to imm.physician and they didnt shot any vaccine but only mentioned in form 693A that my vaccination is complete.i resent it with motion but denied ,and it took 4 months till i reapplied.

We have a copy of the certified receipt, as well as the reciept from the post office that shows the zip code it went to. However, certified receipt tracking numbers are only retained on the usps system for 90 days, and although we know for sure that at the time when we checked, it was delivered for sure, we have no way of proving that.

What is so upsetting about this is that Davids employment authorisation has been revoked, and we had planned a trip to the UK in late April. We have an advanced parole for a year, but because of this, we are wondering if it will still be valid, as the letter we recieved says something about being eligible to recieve a grant for voluntary departure from the US,whucg must be submitted within ten calender days.
