AOS paper- Maiden name of married name?

Does my new wife need to do her AOS papers in her maiden name or her married name? She is here on a K1 visa and we were married on March 11th.

Her married name. Since she is not the USC, there should be a space that says to list any other names used and that is where her maiden name goes. But her married name needs to be used since you are now married.

If she wishes to keep her own surname she can - and use this name when filing the AOS

If she wishes to take your surname she can - and use this name when filing the AOS

Or...if she wishes to hyphenate her name, she can also chooses this - and use this whern filing for AOS.

Actually, your wife does not have to use her married name if she does not wish to change her name. It is a personal choice. There are a number of us here on VJ who chose to stay with our maiden names for various reasons.

Note, though, that if she uses her married name, she will also have to file her taxes, obtain her driver's license, and have her SSN in that name as well.

However, she will have to file taxes in whatever name her SSN is currently under. I took my husband's surname, but filed taxes in my maiden name But that's a whole other ball-game!!
