CR1 Petition Denied, Please help!!!

Good morning everyone,

I'm seeking help, I just got email confirmation this morning that my wife Cr1 petition was denied. After 7 months of waiting and now this! :crying::crying:

First I received a RFE, I did submitted all proper documentation, they had requested a judgement copy from my previous divorce.

But now I got denied and I don't know why? Has anyone gone through this in a different scenario that you submit your evidence and then you get denied.

I still haven't received the letter explaining why were the reasons for the denial. But I was hoping that after I had submitted my evidence we were going to get approved.

I read through the forums that you can appeal your denial or you can reapply all again. Another thing that is heart breaking is that my wife is pregnant and expecting our first child I was thinking that this process would be done before my son would be born, but now I don't think so. :cry::cry: If anyone out there can please help me and advice me what steps to take or what to do, I would really appreciated. Thank you in advance!!!

Hi,

Sorry about the denial.

You will have to wait for the denial letter to see the reason for the denial, then you can address it. No one can advise you on the next step without knowing why the case was denied.

You can only appeal if USCIS made a mistake.

Whatever we say would be guess work - such as was your ex wife also from another country? Was that divorce clearly done before this marriage? Any open issues there?

Can I just say I understand your trauma and I hope you two can overcome this.

i did just that and appealed ($110) and they upheld my appeal and validated the marriage and said reapply

in my opinion and only mine

Reapply

by the time you get to the Steps to explain anything to immigration, you will have the denial notice and can address the issues

it takes about 3 months after USCIS gets the denial letter back (that can be 2 or more months) to get the letter explaining why

and the whys are stupid

ours was He didn't know what books i read

SERIOUSLY????

my dad was married to mom 50 years and couldn't tell you what books she read and they lived together

OP has not interviewed yet, USCIS denied them after they received the RFE.

OP should wait to see why USCIS denied the petition so they can submit the correct documents at the next filing.

It is rare that USCIS denies at this stage though it happens all the time at the embassy that visas are refused and

petitions are returned.

Your problem was a finding of lack of bona fide and OP's has to do with the required documents and what exactly we don't know

yet. If OP files now with the same documents the same denial would happen.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Regarding my ex-wife she was from here. Yes the divorce had been clear long before I got married again. No open issues.

Thank you Auds, this is devastating first you have to wait for a period 6 month plus, they request RFE's which I submit and now we get denied.

I assume that's your wife in your profile photo. You make a good couple. I am so sorry for you two.

NOA1: February 8, 2016 Nebraska

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

You are saying not to wait for the denial letter, and reapply again. so if I reapply I would have to start all over from the beginning and submit everything and pay the appropriate fees.

In your case your explanation letter was not good enough to back up your case, and USCIS still deny you. WOW!!

In my case I submitted everything they had requested for evidence and more, so that I would like to know why we got denied.

I really appreciate your suggestion.

Yes, it is rare I don't understand why would they deny our case. When I know for sure I submitted everything they have requested from us.

Yes that my wife before we got married and that picture was taken here in the States out my house.

Just a thought.... Is it definitely the I-130 petition they have denied? You have in your timeline that you also filed an I-129F for a K-3 (and why not, it doesn't cost anything so it's worth a shot. We have also sent an I-129F). Maybe it's that petition that has been denied?

Let me ask you guys a question, regarding this denial from my case. Since I still haven't received the letter for my denial.
Before all this mess I went to the USCIS in Los Angeles to inquired about bringing my fiancee soon to be my wife to come and live here in the US.

I ask the USCIS representative since I honestly had no idea what were the procedures or steps I needed to take to bring here legally.

She answer me since your fiancee has a B1/B2 visa and you guys are getting married in Mexico which we did, you can just let them know at the border that you guys just got married and your return back, and then you could start the process for her residency here. Well we did mention that that we were newlyweds, but it didn't turn out as she had mention to us. :ranting: They revoked my wife's B1/B2 Visa because we had said that we were married and she was coming here to live with me. :cry: They didn't allow her to cross with since her visa was not a spousal visa but a visitors visa.

Now she doesn't have a visa to cross and visit me and now we have to wait until our this mess is finish. :crying::crying:

Can that be one the reason for her denial, we were honest and they put it in her report when was denied her entry to the US.

I also have read that she can't reapply for a B1/B2 visa since I'm already applying for her, it's that true?

Another question, Has anyone got a denied and then turn it around for approval?

If anyone has encounter something similar to this please help.

Just a thought.... Is it definitely the I-130 petition they have denied? You have in your timeline that you also filed an I-129F for a K-3 (and why not, it doesn't cost anything so it's worth a shot. We have also sent an I-129F). Maybe it's that petition that has been denied?

They denied both the I-130 and I-129F K3

With a revoked B1/B2 visa and having the intent to immigrate, it's highly unlikely that your wife will get another B1/B2 visa.

Sorry, but many people have been burned by the USCIS MisInformation line. They never should have given you that advice.

You have to stop driving yourself crazy by speculating as to why the cases were denied. You have to be patience and wait for the denial letter.
