But listed on the birth cert or not, he IS still the father of the child. It just asks you to list ALL your children. It does not ask you to provide a birth certificate, or prove the child is yours. And a child being listed on the I-129F does not mean they will be applying for a visa.

I would list the child as his, and continue to list the child as being both of yours throughout the entire immigration process through all forms, such as AOS and ROC, etc. And the OP may want to look into having the birth certificate amended to add the father's name.

If it is his, I do not see a problem saying it is. For immigration, it works in your favor to have a child together. For the K-1, it certainly helps prove you have met in person within the last 2 years. Having his name on the birth certificate would be best. When proving bona fide relationship/marriage(for later), birth certificate of children you have had together is one form of documentation for that.

You can still list the child as his on the forms. If asked about it at the interview, you can explain. Not sure it would be questioned though, since the child is not applying for a visa, just he is.

Check with your state about how to amend the birth certificate so you can add him as the father once he is in the US with you.

You have to make enough to show you can support him, if you can not, you have to find a Co Sponsor... if you look at the Guide section at top of page, there is so informational reading that should help you understand the process and all what is required.

Does it matter how long youve been working or as long as you reach the proverty guideline for the income?

In theory, no. You won't be able to provide a tax return to show proof that you made 125% of the poverty level LAST year, but you can show that you're currently making enough money if you can provide a letter from your employer and provide paycheck stubs to show proof of how much you've been making.
