I submitted my I-130 petition for my spouse on the 1st of March 2016. At the time my passport was due to expire in June 2016. I received an RFE on the 7 th of July asking be to send in an unexpired passport. However when I submitted my application it was not expired. Why would USCIS send me an RFE for that?

Because by the time an officer started reviewing your petition, it was past the expiry date of your passport and they can't officially use an expired document as a reference.

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

When they finally do go to issue the visa, the requirements say that your passport must not expire within 6 months at the time of issue.

They probably reviewed your package starting July 1, therefore, your passport has expired. Just bad timing I guess.

The passport in discussion belongs to the petitioner not the beneficiary, so it has nothing to do with visa issuance requirements.

Thank you. Does that mean they haven't reviewed my case and may send me another ref once I have send in a valid passport if the event that they may need further evidence?

If that was your proof of US Citizenship they may be requesting it because they need a current form of ID that's proves citizenship when they are reviewing the petition.

It's highly likely that they are done reviewing your documents they have. Usually they would ask for any additional evidences in one RFE though not impossible to get another RFE. I think after you send them the copy of your valid passport, you can expect the approval soon.

If your passport was what you sent in, instead of your birth certificate, they do pay attention to the expiration date. Too bad for the delay! Good luck :D

At least you know someone has touched your case and it is in progress!

It does seem petty but they follow every rule to the letter. When they touched your petition, the passport was out of date. The fact that petitions sit gathering dust for months in Nebraska, causing passports to expire, is a whole other matter.

Timeline in brief:

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath
