A friend of mine was threatening by his usc wife after he got his 10 years green card that he would report him to immigration due to marriage fraud he would do anything to deport him,how is that possible he got his green card in July 5 and I told him she can't do nothing about it she's threatening to have made appointment to see one of immigration officer,how true is that can that affect his Greencard even if the wife tries to implicate him. ?

At this point with a 10 year green card the US citizen can do nothing

the immigrant needs to get his things ( all belongings and documents like the green card, SS card, passport, etc) and move out and on with his life

immigraition will take her complaint and do nothing unless both committed the fraud

the following are the things immigration is concerned with

What are typical types of visa fraud?

  • Presenting false documents to apply for a visa
  • Concealing facts that would disqualify one from getting a visa, like a criminal history in the alien’s home country
  • The sale, trafficking, or transfer of otherwise legitimate visas
  • Misrepresenting the reasons for requiring a visa
  • Counterfeiting, forgery, or alteration of a visa

Criminals commit visa fraud to:

  • smuggle aliens into the United States
  • flee from prosecution
  • facilitate drug trafficking and terrorist operations
  • assist with other crimes, like remaining in the United States illegally

unless he falls in any of the above, she will be told to divorce and move on

I noticed this subject comes up most of the time after the person receives the GC... until he/she gets the permanent GC everything seems fine...it's odd huh.

Yes, it seems once the "power/ability to give a green card" is gone, the US citizen spouse turns to threats to restore the balance of "power". Rotten, immature people!

Or, it seems to me equally plausible that these USCs feel duped/used once the immigrant no longer behaves lovingly towards them after obtaining their green card.

I get this is an immigration forum, but still good idea to keep one's biases in mind and avoid pre-judgements if possible (ie immigrant = good, usc = rotten)

I get this is an immigration forum, but still good idea to keep one's biases in mind and avoid pre-judgements if possible (ie immigrant = good, usc = rotten)

You should check out my replies when LPRs seem overly concerned with getting and/or keeping their GCs when the relationship has fallen apart or they have not bothered to create nor gather evidence to prove their marriage was bonafide.

Perhaps then you will have a more unbiased view of my posts.

There are a lot of Internet myths about this scenario. Many believe that they can have the immigrant deported at any stage, just because they've changed their mind/do not like each other or a multitude of other trivial reasons. We had a long-running discussion on a Facebook group I am in about this. In fact it involved someone whose visa journey was the subject of a reality TV series. The couple have since split and are in divorce proceedings. The USC thought that by divorcing him he would have to leave the country. Many also thought the same. It was pointed out several times that immigrants on marriage visas can remove conditions alone after divorce if they can prove the marriage was entered into in good faith.

In the case here, a 10-year card had been issued so they recently went through the removal of conditions (during which they both had to demonstrate the relationship was bona fide). I don't understand the sudden change of heart but once that card is issued, he'd have to break the law to be deported. A disagreement with his spouse will not cause him to be deported.

I don't know what part of "permanent resident" these USC spouses don't understand?
