As A'n"L said, having a pending job offer you can expedite your EAD.

You should call USCIS call center and place a request to expedite.

They will ask you a reason - pick # 1 "Severe financial loss to company or person". They will give you a # of your request (Referral ID). Write it down.

Within 5 days (or so) you should receive an email or regular mail:

"Type of service requested:

-- Expedite

The status of this service request is:

Upon receipt of your request for expeditious handling, your case was reviewed and a determination was made that we need additional information to make a decision regarding your request. Please fax proof of your financial loss, such as proof of a pending job offer, to the following number: 123-456-7890, Attn: XXXXXXXXXX. Please include this notice with your fax. Documents should be submitted with an official letterhead"

I faxed my pending job offer along with a Cover Letter, where I explained why it could be my financial loss.

It took 2 weeks to receive my EAD after placing the request to expedite.

Good luck! :)

Thanks again for this info! I received my appointment for BIO which will be on the 26th of this month. I've read that one can only expedite after BIO, and I'm not sure if I should get in touch with them before to try to expedite the BIO appointment as well, or just wait after the 26th.

Also, what did you write in your Cover Letter? Did you have to explain why it would be financial loss? Thank you again for your help!

You are welcome :)

I agree - since you have already received your BIO appointment, it is better to try to expedite your EAD after you get your BIO done.

In my Cover Letter I wrote that I appreciate they have responded to my inquiry and have reviewed my case; that I really would like to take this pending job offer, because 1 ) similar opportunities are hard to come by and 2) it would be my only income. And should they have any questions or need further information, please contact me...

Actually, Cover Letter is not required - they already accept a pending job offer as a financial loss. But I think it wont hurt anyway :)

P.S. You will be at the USCIS office for BIO anyway, soon enough.. Maybe you could schedule an infopass appointment for the same day and try to expedite your EAD in this way?... Just an idea..

Good luck!!!!!

Thank you again for writing, this is very helpful...! Everything you mentioned makes perfect sense. It's just a bit weird to have to present a pending job offer as financial loss, or at least to me.

I agree with you about the infopass appointment! How does one go about trying to schedule one? Would I need all the documents ready for that appointment?

As far as I remember (sorry, it has been a wile since my last infopass) you will need your NOA-1 of your I-485, the NOA1 of your I-765, BIO. You should be done with your BIO by the time of your infopass, so you will have a BIO letter stamped. And of course, your ID - passport, driver license..

Forgot to mention - if your request works out, probably only your Work Authorization will get expedited, not your Advance Parole. So you may not receive a "combo card" . You will have an Employment Authorization card and your Advance Parole may arrive in its time as a separate document.

My son and I expedited our EADs almost at the same time. He received a combo card, with AP, I - just Employment Authorization and my AP was received 3 weeks later as a separate document . Really don't know what it depends on. "Human factor" maybe? :)

I see, that's, again, very helpful. How does one go about scheduling an infopass? From what I've read, the duration of the BIOs can be hard to predict, so I'm not sure when I should try to schedule an appointment after the BIO appointment time.

Infopass, usually, doesn't take longer than 15 -20 minutes... Is your BIO scheduled for early morning?.. I would, probably, scheduled this like 2-3 hours later than BIO. And if it doesn't work and you don't show up for your Infopass - nobody is gonna "punish" you :) Infopass will be canceled automatically, and you still can put your request to expedite your EAD by calling to the USCIS customer service.

Great, I will surely follow your advice. My appointment is at 11:00 am so I will book it for 1pm. I should probably show up with all the required documents (NOA, cover letter, and Job contract), correct? Thank you again for all your help, and I will update this after the appointment!

..your ID and your BIO appointment letter :) It will get stamped and returned to you, when your BIO is done.

Yes, please, let us know how everything went...

Hope it will work for you! Good luck!!!

Will definitely keep you all updated. Now unfortunately no infopass can be scheduled at any USCIS office near me (and I live in NYC...). No appointment are available. The office in which I'll be doing the BIO doesn't even show up in the list of office that would schedule an infopass. I guess I'll

Just have to call after I'm done with BIO!

Posting an update on my current situation!

I was schedule to have my BIO done on Tuesday, and had an appointment at 11:00 am. I went there very early, around 10:30. I was allowed to come in and start the process early. There were no more than 15 people in there, and this was in Queens, NY! The staff was very courteous and pleasant, and I barely had to wait for the BIO process to start. The person who took my prints was also very pleasant, and she made me less nervous than I originally was. All in all I was out 5 before 11am, my original time.

I then called USCIS to place a request to expedite. The person on the phone was somewhat helpful, and was able to nudge me in the right direction and took my request. I had to explain over the phone the reason this qualified as financial loss. I basically told her that these jobs are hard to come by, that it's definitely a career job, even if it is only part time, and that it would be my primary if not only source of income.

I received the RFE less than 24 hours after this call was placed! On the following morning! I was really shocked because she told me to expect 2 to 5 days before they would reach out. I faxed them the notice along with the contract, and a short hand-written cover letter on the fax notice (since I had to go to a store to fax the documents) explaining I appreciated that they considered my request, etc.

Just now, I received an e-mail confirmation saying that they received the documents and were reviewing my request. I hope this works out!! Will keep you all updated!

Another update! I checked the status of my request on the USCIS website, and it says that my case was approved, and that a notice was on its way. Pretty amazing, and interestingly enough, I also checked the status on the other forms, and the advance parole document was also approved. I'm not sure if it is related to this in any way, but just thought it would be good to share!!
