Hi guys,

I'm starting to gather the information needed in preparation for my fiancé's interview, and I've come across a bit of a dilemma. For the Affidavit of Support (Form I-864) I cannot provide proof of financial support because I am a server at a restaurant and I almost always don't claim all of my tips, therefore on pay stubs it does not provide the actual amount I indeed make per pay period and my hourly pay is only $2.13, which is always taxed out completely come pay period. Also, I have only been employed with this company since last December, due to visiting my fiancé in his home country, and all of my previous jobs were also serving jobs and my W2's are not above 125% of the poverty line. Our application has just got sent out today from the NVC for the Embassy to collect, and like everyone else I don't want to wait longer than I have to. Thus being, what are my options?

Use a joint sponsor. For K-1, you need the I-134.

I-864 is for later, you use it for AOS.

Joint sponsor? How does that work?

The co-sponsor will use their income or assets to prove the financial support for the immigrant. Basically, instead of you proving income (or assets) the co-sponsor would prove to be within the needed guidelines, and provide all supporting documentation. Perhaps, you could ask a family member or friend to help with this. Just remember whoever the co-sponsor is, they're ultimately financially responsible for the immigrant to not become a burden on the government.

I-134 is not legally enforceable and it only covers the 90 days. Now if OP has to use a joint sponsor during AOS, that's a different story. Right now they are going for getting a K-1.

But what if I'm not living with the co sponsor? Because I do in fact live alone. Also, what would this co sponsor need to provide me with to prove my fiancé's financial support?

Right now I'm just referring to the 90 days that my fiancé will be here. Unless they require proof of support for a possible green card also during the interview?
