Hi everyone,

This is my first question! Hope you can help me out....

My husband recently immigrated to the US from Uganda. He originally came on a K-1 visa, but we just received confirmation today that his permanent residence has been approved. Meanwhile, he was accepted to go to graduate school in the UK as a Ugandan citizen. We are concerned that if he applies for his UK visa in the US, it may affect his eligibility, but that if he applies in Uganda, he will have problems when trying to re-enter the US.

If he chooses to apply for his UK visa from Uganda, do you think he will have issues re-entering the US? We have planned well and will make sure he is able to travel back to the US approximately every 4 months within the year he will be at school. From what we have read, this should be well within the guidelines of re-entering every 6 months.

Essentially, do you think that immigration will question why he applied for his UK visa in Uganda instead of in the US?

Entering briefly every 4 months may not be enough.

GC is for living in the US, so in general he needs to spend more time in the US then outside of the US.

Alternatively he can apply for a Re-entry Permit using I-131.

I am not sure why you think it would be better to interview in Uganda, could you explain.

That seems to me the only issue.

That seems to me the only issue.

So hubby was offered financial assistance on the basis that he is Ugandan. While his citizenship hasn't changed, we don't know if applying from US for a visa could affect his financial aid....Also he was given a unique CAS # to apply for UK visa, again showing that he is applying from Uganda.

Since his absence will be for academic study and will not last longer than 1 calendar year, we thought it would not be a huge problem. We even applied for AP before residence approval came today.

Should be easy enough to find out if he needs to be Ugandan resident.

The Re-entry Permit is different from AP. (I realize the same form is used to apply for both, but they are NOT the same thing.)
