My wife and I will go back to Taiwan next week for her CR-1 interview and hopefully receive the green card once we are back in the US. She now has a K-3 visa attached to a page of her visa and if everything goes well will receive a CR-1 visa atttached to another page and then a green card. Her Taiwanese passport will expire in 3 years and I assume the CR-1 visa attached to it will no longer be needed once she gets her green card, correct? Or when she gets her new passport will we need to go to a USCIS office to get a new CR-1 put in her new passport?

10/10/06 Receive, complete and submit I-864 and DS-230

You get the green card a few days or weeks after re-entering the USA on the CR-1 visa.

It is your permanent Resident Card or I-551 Card. It is not actually green in color.

The term green card has been a misnomer since the 1960s when the US switched to various hues of blue and, most recently, pink. As shown in the above picture, the new version continues this trend.

And NO she wont need another visa attached to her new passport when she gets her new passport. The Visa is a single use visa, and then the green-card allows travel after that.

My wife is already here in the US, the K-3 is a non-immigrant visa, we have to go back to Taiwan to get her permanent CR-1 visa next week or adjust status in the US. Since we were going back to Taiwan anyhow I thought it would be easier to get the CR-1 there.

Hmm....If your spouse already have a K-3, you can just migrate to the great USA. No need for CR-1.

The green card is required as documentation that you're a permanent resident of the USA.

Does she have AP then???

K-3 is Multiple entry....she doesn't need AP if it the K-3 is valid.

Not sure exactly about CR1 as I did K1.

Her K-3 visa is multiple-entry, we can come and go as often as we like. You are confusing it with K-1 which is a single-entry visa..

The green card is required as documentation that you're a permanent resident of the USA.

K-3 allows 1 of 2 things, either wait for the CR-1 visa interview and return to home country for that interview and then re-enter USA and get green card. (This is what the I-130 petition is all about), Or do AOS in the USA.

The OP opted to do the former rather than the latter, and is now at the stage of CR-1 interview.

I understand what you did, you applied for both, and you finished out your CR1 while your wife was here on K-3.

We did the K-3, Cr-1 too but chose the AOS in the USA.

I doubt that in 3 yrs when the passport is renewed she will need any visa, she will be able to enter with her greencard.

You might want to ask this question in the Cr-1 forum, thye might be able to telll you how the green card is issued, after entry with a CR-1.

hi miker,

Once your wife re-enters the US with an Immigrant Visa (CR-1), she becomes a Permanent Resident. Evidence of PR status is, as Yu&Dan showed, a Green Card and/or the endorsed visa in her passport (it gets endorsed at entry). IF she has been married for more than two years AT THE TIME SHE ENTERS THE US, she will have IR status. More on that if that will be your case.

There are a few times when she might need to go get her passport stamped while she also has a Green Card; your answer to the marriage anniversary will dictate the answer. If she IS admitted as CR-1, she will need to file I-751 2 years after she becomes a PR (at her entry, remember).

Please read the links in my signature for information on Permanent Resident status, including the rules, rights and responsibilities she can expect as a US PR.

A K-3 is not enough for becoming a PR; a K-3 must either Adjust Status in the US, or return to their home country for an Immigrant Visa.

As noted, K-3s are valid for re-entry to the US for up to two years.
