Hi,

My K1 spouse turned out to be a fraud. We married in April and filed for AOS in May and got bio metrics done in early June. Right after bio-metrics find out (don't want to go in that detail) she defrauded me and was in the impression that she is all set since she will get the green card in the mail without an interview once the bio-metrics were done. When it was 100% clear that she defrauded me and she accepted this then I gave her two options either leave the country now (the very same day) or let me contact the authorities to handed you over to them. She chose to leave voluntarily. I bought the ticket and took her to the airport and made she she left the country and this is confirmed from the I-194 record.

I realized I made few blunders that I let her go without getting the proper divorce or the annulment done. She never got the SSN or any state ID. I need to know if anyone here gone through the annulment process in the similar kind of situation then I would like to know your experience. Any guidance or help would be greatly appreciated.

You will need proof that she defrauded you. Did she state that in writing?

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Thank you. Unfortunately, I don't have any documented proof that she defrauded me. It was her conversation with her cousin that I overheard and caught her red handed and she acknowledged when I confronted. Is there anything I could do? I do have some of her important stuff that she forgot to take with her and I could ask her send a signed affidavit and accept her crime and in return I will send her stuff back to her... just in case.

1. Even though she left, you should still pull the affidavit of support so that he AOs is denied (contact USCIS and let them know you wish to withdraw i-864)

2. Get a divorce

3. Move on with your life
