Sounds like they probably feel all points of the consular findings weren't addressed.

Did you write a letter of explanation and a cover letter and sort everything in categories so they will not have to hunt

for what they requested in 1700 pages ? Without knowing what the NOID contained and what you send it is hard to

say. On the positive side, it gives you yet another chance to get it right versus an outright petition denial.

I had my attorney address the NOIR - I don't think it was in chronilogical order (the letter he wrote) but he thought we had a 75% change of getting reaffirmed. I'm hoping they just have a question about some piece of proof. Yes there is a positive side to this - it's not denied!

Sorry your going thru this, we received a noir, i130 non bona-fide marriage, uscis received our rebuttal on June 17, yesterday I got updated, revocation notice sent, I called uscis they said it's not a denial lol it could be they need something to just follow instructions in the letter when I receive it, revocation last time I looked is a denial lol, so I know your pain, I can't answer your question but I do know the runaround we get, sorry

Are you saying you got another NOIR also? I called USCIS w/some questions and she could not answer them. I wanted to iknow if this is common - sending out 2 NOIR's - she didn't know - i wanted to know once they received an answer to this latest NOIR how much of a delay would it cause - she said once received should be 60 days. She did say the same person that sent the NOIR would be the person who gets the response.

I feel your pain.....I was so hopeful. :(

You need find why they denied then wait on the request for evidence or what they call it. I would ask a senior member here how to do that because we were told at the interview. I pray it goes faster than 18 months but that's what we heard also.

How large no did you wait for this step you just complteed

So here's my update. On Saturday, I got the 2nd NOIR and all they want is my divorce decree from my first marriage which has been sent today to the attorney and he will send in ASAP. My attorney says, he believes that's the only thing standing in the way of our reaffirmation :) He said if they had other issues, they would have stated them in the NOIR and that's the only thing they requested!!!! Yippee .... still praying

It took 5 months two weeks for our answer to our noir, and we got a revocation, they claimed there's no communication between us lol, I gave them proof but the yr wasn't posted on chat history and I can't go but one yr back, so Thursday I see a lawyer, I have 33 days to send appeal , at least it's like another chance

I feel for you dear..... Don't ever give up. what I don't really know is the best root to follow on this matter at the moment. Not sure if is best to go ahead and file for an appeal using form EOIR-29 not really sure how long it will take to get finalized or if is better to file for a new I-130 petition and address their reasons. Others out here will help out I believe. Cheers.....

Just from what I read on the internet - appeals aren't usually overturned but how true that is I don't know. If you refile, it will take another year and I don't know how long appeals take. :(

if you refile - hire an attorney from the get go becuz you'll have to address reasons why u were denied the first time. Good luck to you.
