form I485 questions and AP question

Timeline

I have a few questions. In part one of the I 485 AOS paper, what is my husband's current USCIS status? Since we got married, is he still on a K1 visa? or do i put something else there. Also, in part B, do i put my married last name or my maiden name.

My question about advanced parol is this. My husband needs to travel back to his country in October. I don't feel like paying the 170 dollars, so I wondering if we can not turn the AP form in with all the AOS packet and see if it goes well. If he doesn't get permanent residence quickly, can we turn in the AP paperwork in at a later date if we don't think that the green card will come? Or is it now or never? thankyou!

2/20/2007--K-1 interview and approved visa!!!

3/14/2007--entry into the U.S

3/19/2007- civil wedding

3/21/2007--OAS papers mailed off

4/21/07 Biometrics appointment

6/20/2007--AOS interview in sacramento--almost aproved

If entered with a K-1 visa put "K-1 Visa Holder", if entered with a K-3 visa put "K-3 Visa Holder" Part B Married name,

The example form is very useful for filling these things out.

Don't bother filing AP until at least 90 days before your trip, you may have green card by then and will have wasted some $$ filing for the AP.

He would be a "K-1 Visa holder".

You will use whichever name you are going to use legally from now on (whether that is your maiden name or your married name). From now on, use whichever name you are using legally. If you are chosing to use your married name from now on, provide your maiden name when and if it is asked for.

With regards to the AP, this is always a hard decision, because even though he will most likely have his GC by October, there is never any guarantees. So, if you did not submit the AP application, and October were to come around without his GC arriving, he would not be able to re-enter the U.S. after his return from travel abroad.

You are allowed to submit the AP application after the AOS application, you just can't submit the AP before the AOS.
