I-864, Affidavit of Support

It comes through as a question often when the sponsor is worried if the immigrant (who has skipped town / AWOL) will come after them for support or if the USCIS/government will come after for the reimbursement of financial support if the immigrant becomes a public charge.

Just wondering, if there is way for VJ to report such folks who post here. I mean, the OPs/signor can be tracked via IP address, the immigrant for whom they have filled to provide adequate financial support have disappeared (another issue with leading to illegal immigration or worse) or have become public charge.

Shouldn't the OP be responsible to provide adequate means of financial support and that the immigrant not likely to rely on the U.S. government for financial support as per the affidavit signed by OP.

In most case USCIS/government doesn't go after the OP/signor due to lack of resources. It would be good cause to report such cases and assist USCIS in recovering the expenses and/or tracking the immigrants.

We have, on each page, a link on how to report immigration fraud at the bottom.

We will also comply with lawful orders from any court etc. But proactively reporting cases where someone might do something, with no proof that they have, and on the say-so of a distraught spouse left behind, is inappropriate, and ties up law enforcement resources.

Exactly how are these posters supposed to financially support their AWOL (ex-)spouses? Are they obligated to pay a PI to find them? I honestly don't think so, but I could be wrong.

Yes, they should hire PI or go find the immigrants who are AWOL. If you cannot take responsibility then don't sign the affidavits.

Also, the loophole of having someone other than spouse provide an affidavit of support should be closed. Logically, if you don't have means to support then don't engage in immigration proceeding requiring to provide evidence of financial support. Simply put, don't marry if you cannot afford....have some dignity rather than having other (parents, relative etc.) fill-out affidavit of support.

Until the newest version of the I-864 the AOS was merely to pay back the government if the beneficiary used means tested benefits. They were not required to support a spouse should a divorce occur anymore than they'd be required to support a USC spouse of similar duration.

However I agree, that in general, I dislike the over abundance of joint sponsors. There are only a few instances in which I think they should be allowed, but it would require more thought and time into people's applications for a spousal visa than is currently given.


And I completely agree with Penguin. It's not up to VJ to report people.
