Dear Friends,

Hope you are fine and good health. In August 2015, i got F-21 visa and sealed envelop from Embassy. I was told that as soon as i will land in USa, i will get 10 Years green card.

Well, i never land in USA and what happened is that me and my Ex wife had clashes and she torn my visa page as well as she took my sealed immigration envelop. Later on, we had divorce. She has gone back to USA. We also have 1 year old son.

I just want to ask is there any way i can go to USA now? Obviously, i cannot apply for F21 visa because it has been expired and i also got divorce now so wife cannot sponsor it again. But is there any way i can go to USA on bases of my son? He is 1 year old now.

Is there any way i can get F21 visa without involving wife? i am just asking is if there is any way out. If i can tell embassy that this has happened to me, will they issue me F21 again?

Please let me know.

Hi,

Sorry but there is no path for you to immigrate to the US. The only way to immigrate through your son is for him to petition for you when he turns 21 years old.

You can try to apply for a tourist visa to visit.

If you want to immigrate, your son can only file for you once he's 21 years old.

Thanks for your reply. But i talked to one lawyer and she said that it is possible to come to USA. She said if you come on visit visa, i will be able to help you to get F21 visa again because you green card is ready to be issued. Actually, i did not travel to USA and my wife torn my passport visa page and took immigration envelop. Could it be possible that if i get there on visit visa, can i appeal for my green card to be issued? That lawyer told me that you marriage was last more than 2 years and after getting F21 you get 10 years green card. I am confused so please suggest me is that lawyer saying true?

Dear Friends,

Hope you are fine. I got F-21 Visa in August 2015 but did not travel on it due to clashes with wife. Eventually, we got divorce and my wife took my Visa page and Immigration envelop.

I have heard that F-21 visa is issued after 2 years of marriage and it does not depend on Spouse. If it is true, than could it be possible that i can get F-21 visa again? If i request to US Embassy, will they issue me F-21 again? If it is unconditional, than embassy is not going to ask for petition from wife etc. I am divorced now but F-21 was issued to me, which is a category of Green card. Please let me know if some one has accurate information about it. what i have heard is that F-21 is a green card, and even if your wife took your immigration envelop and visa page, you can still get it because it is a green card category.

Please help me out.

that doesn't apply to you, you still have to be married, if you have been married over 2 years, when you enter the country you will get a 10 year GC, you won't have to remove conditions before the card expires, that's all

married spouses over 2 years automatically get a 10 year GC, married spouses under 2 years get a 2 year GC once they enter and have to remove conditions to get the 10 year GC

in both cases you have to be married to enter the country, it is a spousal visa and you depend on your spouse that has petitioned for you.

you never came to the US, you are no longer married so there is no spousal visa

First of all, what you are trying to do is a fraud. Then again, you will probably not get a visit visa especially after you already went through immigrant visa process. You are getting false information from the lawyer. That lawyer just wants money from you by giving you false hope. Your F2a visa you are talking about is useless now after the fact that you two are divorced and you have not entered US.

In a matter of time, this thread will be locked, so just remember what others have said. Your current F2a visa is NOT a Green Card and whatever that lawyer is telling you is all NOT true.

No matter how many times you ask, the answer will be the same. You can ask a thousand times, and the answer will be the same.

Forget the F-21 visa. It has expired, so it's no longer good. You can't get it back. Also, you are divorced so you no longer qualify.

The lawyer is lying to you.

The only way to the US for you is for your son to turn 21 years old and file for you.

The lawyer is a fraud. The visa your ex took only would have been good for 6 months IF you didn't enter in that 6 months your green card has been cancelled. You can be sure she cancelled her affidavit of support futher closing any path from that old visa. You need to start all over to find a new path.

This will not be over quickly. You will not enjoy this.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
