K2 requirements please?

Hi family!

I wanna ask what is the requirements for K2 please? Can somebody tell me step by step by sending the petition? I am planing to get my daughter in next 2years. I just want to gather first the information so I can prepare. Anywies,we are going back to PH next month for vacation. And I'm so excited to tell this to my mom about planning to get my daughter. (She doesn't like that plan, really )

I'm sorry, but according to your timeline it's been more than a year since you obtained and used the K1? If so, your daughter is unfortunately no longer eligible for follow-to-join benefits using the K2 visa.

now your husband will have to file the i130, the process will take a year until she can come, is her dad in the picture?

Hi,

A K-2 must be issue within one year of the K-1. The law does not allow the US Embassy to issue a visa after a year. Since you got your K-1 in 2014, your daughter no longer qualify for a K-2.

Have your husband file an I-130 for your daughter. It will take about a year to get a visa.

i'm sorry but i don't understand what u mean about the picture? You mean the birth certificate? My daughter's certificate has no father. Thanks goodness.

that's what I meant, is the father in her life and is he the father in her birth certificate?

because if she had her father's last name, unless she had sole custody, the father would have to authorize her leaving the country

since there is no father, then she is good to go

In the PI mothers automatically have sole custody over their children who were born out of wedlock. (Forgive me if I am assuming wrongly that that's the case here.)

CR-2 is the visa category for children/step-children of USC's when they are petitioned for using the I130 petition.
