Hello. I am a bit confused on the AOS. So we married July 1. I have no chance to pay AOS in one lump sum. I could not find if they do payment plans. Also, the only thing with her new name is the official marriage certificate. So what has to be done to make sue before AOS that she is not booted from country? We applied for her SSN and still waiting... 2 months going.

There is no payment plans in dealing with the USCIS. You must send the full payment with your application.

No one is going to boot her from the country, but it is in her best interests and protection to file for AOS as soon as you are able to protect her status, her legality, and enable her to work.

You have to save up or borrow from friends/family.

The sooner you file, the sooner she'll be able to work. The SSN, when she receives it, won't allow her to work.

You need to file for AOS, EAD and AP. About 90 days after filing she'll receive her EAD/AP combo card and she'll be allowed to work.

Did you go back to the SSA about her SSN - 2 months is a long time

Save some money if you can't borrow... this is something you should've planned for when you brought her here... as others have said, even though she will not get deported for AOS delay, the sooner you file it, the less headaches you'll encounter when the time comes.

Also note that her medical at SLEC only lasts a year after she made it, so if you file after that date, she will need to complete a i-693, which requires a civil surgeon to complete and that may entail more money out of your pocket.

And follow-up on that SSN... two months is too long unless there are some issues.

I appreciate the feedback. I do have some replies...

Transborderwife, and others, about the SSA, they keep saying "in progress."

tolitzpogi, it would take years at the current rate. I exhausted all I had just for the visit. With a poor economy from our jobs over seas, and lower demands, very hard to find proper work for someone with my status. Can not get second job because I do over time at my temp one, and I am either over qualified or under qualified for others. Just letting you know that "saving" is not an option with low funds. If I planned for that, she never would have ever come to this country since planning is irrelevant. Oh, and the unexpected medical and car issues that sucked up rent money, yea, that always happens (obviously it just did). I understand what you are saying, do not get me wrong. But the government sucks enough that I sometimes have hope they are willing to be cooperative. I tried reading all the links about AOSes, but like trying to understand the K1, took months to figure things out properly (and many posts to this site).

P-ana, she had no funds herself because of her poor work environment. As for planning, as I mentioned above, I could plan all I want, but the fact is, more funds go out for necessities than they come in. With recent medical and car issues, sucked up even more. She is trying to find a way to make things for us to sell on Craigslist. She is creative.

NuestraUnion, funny but no. My school loans been in default since I was laid off, and my credit went from 800+ to death.

All I can do is keep on working and find a way to save a few bucks (talking double digits) a week to put together, but one unplanned event will kill it. I was just hoping there was an easier way.

I'm sorry you're in this situation and I hope you two can sort it out very soon. I will refrain from commenting further, as I feel this is not place to.

But please keep in mind that being here, a whole new country, with different culture, language, people, etc, and on top of that being illegally here is very tough. Not being able to live fully, always feeling left out, hidden, feeling dependent... It messes up with self esteem and mental health, it is no joke.

Might be my eyes but I can not find how long I have to apply. Her medical paper expires at some point too, right?

You can wait for as long as you need to. But her medical will be no good after a year and you'll need to redo it if filing the aos after that (it costs a lot more to have a medical here in the USA)
