Hello,

I am not sure if this is the right place to post this and if it has been already answered or not but I have several question regarding i-864.(apologies to whoever have to move this thread) I just got my NOA2 and I read the NVC guide for i-130 petitioners for spousal immigrant visa. I understand everything on there but based on my situation, I am a little confused on this i-864 form.

Here's my situation:

1. I am a student currently and still am (finishing master's) and so for the past 3 years I have been unemployed and receiving financial aid. However I have filed taxes (most likely dependent under my dad or alone, not sure which one but will confirm). If i haven't I am sure I will provide a letter explaining why. I was employed in the year 2013 but for 6 months only and it was above the 125% poverty line for me alone. I am sure sure if I should mention that or not. I am filling out i-864 that I know for sure and asking a co-sponsor. I recently got a job offer (I have a job offer letter stating I got a job) however the job is contractual and it requires a security clearance (secret kind) that means I am right now going through a clearance and I can't start the job until I am given either an interim clearance or a full clearance (wait time is 2 months for interim and possible 6 months to a year for full). Which ever one happens, I will start the job then. That means as of right now I am unemployed and it is not guaranteed job if I don't get an interim in 2 months or if the job is not available after that. Keeping my fingers crossed here. Anyways I am filing i-864 as unemployed at the moment.

2. With that said, I am thinking of using a joint sponsor. I was thinking of doing my parents but here's the thing. My mom have worked in the past 3 years, however my dad just got a job after a long long time. due to his health issues for a long time he didn't have a stable job. He did file taxes for the most times in the last 3 years. He filed jointly with my mom (i believe) and I was usually under him as dependent along with my sister and brother. Now here's my dilemma, can I use him as my co-sponsor and my mom for this? I mean he just got a job that means I can use his current (2016) salary requirement and job letter information to do this right? If yes, then is it okay to show his tax returns or show a letter why he didn't file tax return for one year?

3. I was thinking of using my brother, who has been working for a while now and he has been filing taxes and he recently got a really good job, which I can just use only him to help me with my i-864. Can I do that? or does it have to be my parents?

4. If all else, my dad suggested on using one of his clients to help us out in this matter. can we do that? Is it possible?

I posted this question elsewhere and so far no one has been able to help me so hence the new topic.

I am a student and unemployed, however I am using my brother to sponsor us, that means he is filing out the i-864 as well. I am a bit confused about how to fill out the form as far as showing my current income. For now I have stated that I am making 0 income but how do I show that i am making income through other means because in my household size there is no place to indicate that. The same is also true for my brother about the household size. I need a bit of help with this from someone. Please message me if you dont want to say anything here.

What do you mean by you are "making income through other means"?

Okay basically what it means is that I will be supported by someone or dependent on someone. In the NVC site about beginning the visa process, it says to show if I am making income through other means. so basically if I am living with my parents or my parents are supporting me then I have to state that. in this case i am using my brother to sponsor us, so there is a section it asks how am i making income or how am i being supported, there is no way to show it on the form. I don't know how to do his form as well where it asks about the household. that is why i am asking all the unemployed people for help.

How can you have 0 income and have income through other means at the same time?

Being supported by someone or dependent on someone is not income to you. You are misunderstanding the concept of income. Income comes from work or investments. Income does not include being supported by someone else.

Your parents support you. That support is not income.

Your brother being a co-spoonsor/joint sponsor has nothing to do with you having income.

You are misunderstanding things.

and you are misunderstanding what I am stating. below is what the National Visa Center stated for people like me and I quote: "For those who are unemployed or retired, submit a photocopy of ongoing income from other means, such as:

  • retirement benefits;
  • other household members' income; or
  • other significant assets.

Here's is the word "income" from their site. so please explain to me how am I not understanding what they are stating because the AOS form does ask for it. If you can help me on that please that would be great, if you cannot, then please guide me to someone who can.

You are right - support from your parents and your brother being a JS for your wife is income to you.

For someone who can help me here:

I am not taking support from my parents in this matter, I can and make my case stronger but I am taking support from my brother, which is why i am asking how do i show it on the AOS form? Should I mention it in Part 11 or is there another way to show it and I don't know...?

I was being sarcastic since you seem to have an attitude.

I know what the section from the NVC said and I explained it to you. You rather read part of the block rather than the entire block.

It's all right if you misunderstood me. I seriously need help in this matter, if you can help me please do if you cannot then please tell me of someone who has been in the similar situation as me and maybe they can help me out here.

just to clarify, I have read the entire section and not just once but many times. I am planning to use my brother as a co-sponsor so that means he will be filling out i-864 form and not the i-864a form. He got a job recently and he hasn't been part of the job for 2 months even. I am doing his AOS with his permission, just the information part of course he will sign that, where am I suppose to put in myself and my husband to show that we will be under his household? I mean, so far what i read, i can't show it as immigrant for myself and unless i missed something, where am i supposed to explain on his and my form that how am I living or paying for my expense in the us? for me, my "income" or means of "income" is through my parents or brother in this case. I still have to fill out the AOS since I am the petitioner and in that I do show how I am not making any income. I quoted the site because that is how they used and i said it in my original post that they are asking for a means of income (which is what it says doesn't it? am i reading it wrong here? even word by word?)

look clearly you think I do not understand the word "income" or the concept of "income." I do, after all I have worked in the past so I know what income means, however NVC site does state it that way for people who are in similar situation as me. My means of "income," which is what I originally meant, is through my parents (a household member for me since it is my parents or siblings) so how am i suppose to show that in my form? how am i suppose to show it on my brother's form? So at the end of the day, is it even worth discussing that the word "income" means for me? I mean it seems to be pointless for me to learn the word "income" in different context when I understand what it means. the conversation of what income means deviates from the help I need, at least that is how I feel. Which is why I just want someone who has been through similar situation to help me or someone who knows what I mean to help me here. Does that make sense to you? So please don't mistake my cry for help or hurry to move on from this situation to the matter at hand as something with "attitude problem." i hope that clarifies it.
