I'm filling out the I-864W, (Intending Immigrant's Affidavit of Support Exemption) for my 13 year old stepdaughter. In their home country of Namibia, I married my wife and then adopted her daughter.

My question is: Since I am filling out this form for my daughter, do I need to fill in Part 5 "Preparer", or Part 3 "Requestor"?

08/05/2016 - Hubby (agent) received an email from NVC that they got our packages - WAIT 30 DAYS

10/17/2016 - 2nd Case Complete (IR-1)

11/07-10th/2016 - Medical x 2

11/12/2016 - Medical extended 3 days more due to sputum & smear (6-8 weeks to get results :cry:) x 1

12/08/2016 - Interview Results (APPROVED!!!)

01/26/2017 - Medical results received at Embassy (10 weeks 4 days)

01/27/2017 - Visa Issued

01/31/2017 - Visa On Hand

Im not going to get into whether or not you are eligible to use that form or not, Im just going to assume you checked it out completely and are using the right one--

So the answer is you fill out the entire form as needed. Lol.

In part 3 (requestor) thats the intending immigrant. So your daughters info goes there. (Shes not your step daughter since you adopted her but your legal daughter). If you are under 14 years of age, your parent or legal guardian may sign on your behalf. So you would fill out part 3 as your daughter and sign on her behalf based on her age. Question 1 is about whether she speaks english. #2 is you. You are not an attny. 3,4,and 5 are her info. Then you sign.

Part 4 is only if you put yourself as the translator in part 3.

Then move on to part 5. You are the preparer because your daughter did not fill it out. So your info there. And again the bit about if you are an attny.

Hi,

She is your adopted daughter. She is no longer your daughter.

You can use the I-864w since you have adopted her, and she will qualify for automatic US citizenship under the Child Citizenship Act when she enters the US on an immigrant visa.
