OP, I understand your situation. Obvious relationship issues aside, you seem to still care for her and I get the impression that you may still be willing to reconcile if she is willing. No judgement there.

A lot of the other posters are more experienced than I, so I do think that their advice is worth considering - but I do think that nobody truly understands the mind of an embassy interviewer. Users at VJ offer a wealth of experience and knowledge to make it easier for us to succeed in our immigration journeys but sometimes it just doesn't work out the way we want it to. A clean slate is always preferred so that your best case can be presented to the embassy.

It is for that reason that I think your concerns for your beloved may be valid. Other people may have encountered no problems for a student or visitor's visa after a cancelled K1 but again you just never know who you get at that interview window. It certainly is comforting that others before have succeeded though.

This matter may have reprocussions for you both - so perhaps reach out to her and ask her to have a very serious conversation regarding the status of your petition....ask her if she is okay with cancelling it. Let her know that people have been successful, but she can expect some questions at any future interviews. Offer to send her whatever documents she will need (the noa1, noa2) so she can plead her case later on if any issues arise. This conversation not only allows you both to make this decision, but it may lead to a bigger conversation about if you really want to cancel in the first place!

Matters of the heart are complicated enough without all the legalities of immigration paperwork, so I know this is not an easy place to be. Best of luck!

OP, if she doesn't respond to an offer for a neutral conversation about canceling the K-1, then there's no harm in also canceling it even if by chance she has canceled it. I'd doubt she has. Are there any consequences for letting the petition go without you ever responding? Not like jail time, no, but you never know how it could affect you in the future. Why not just save everyone time (everyone, meaning the people who are working on your application that you don't intend on fulfilling and also the other people waiting in line who would really appreciate moving through the line a little faster). It makes you look responsible and on top of your game. Also, like another commentor said, if you let the process go until the petition gets to the NVC, you'll have to submit an IMBRA waiver later, but if you stop it before it gets there, then you're saving yourself time and nerves in the future (should, of course, you ever need to file again).
