I-129F/K1 for Russian Fiance Dilemma

I wouldn't care about a person who lied about "bunch of things".Send her the original NOA 1 and NOA 2 and ask her to write a letter to the USICS and explain them that the relationship didn't work out and she will not pursue the application.

I don't see why it would be an issue for her in the future. She has been honest with the embassy and uscis, never overstayed her visa (right?), applied for K1 because she honestly was going to get married, relationships didn't work out - oh well, that happens. But again, you two were honest about it and withdrew the papers. What looks bad? Nothing. She will have a lot more problems if continues this process without the intend to get married. I am from Russia too, by the way.

Here in lies the dilemma.. I personally want to cancel the papers on just move on but I heard when I do this that she will most likely be denied future visas because the current I-129F will show that she was trying to leave the country via marriage. I heard that this is is true for all future Russian visa attempts (tourist, work, K1's etc). Even though she was dishonest with me and the relationship didn't work out I don't want to be the cause of her not being able to ever comeback to America. I feel like this burden would weigh heavy on me for the rest of my life as she has family and friends here in America.

I need to know from people with direct knowledge of the 1-129F/K1 Visa process for Russian nationals and if what I just mentioned above is true or not.

Also any advice one what I should do in this situation would be extremely helpful.

Not true. If you cancel the K-1 there will be no consequences. She will still be able to use and renew her tourist visa. If you continue your K-1 then when approved her tourist visa will be cancelled. This may make it more difficult to get another tourist visa after she returns to Russia if she actually visits you on that K-1.

If you cancel the petition then there will be no repercussions as it is saying the reason for her wanting to immigrate no longer exists.

If you don't cancel it and she tries to get a fiancé visa for a relationship that no longer exists and they figure out she is lying then she can be done for material misrepresentation and get a lifetime ban.

Therefore my advice is to cancel the petition and so avoid issues for her in the future.

To use an analogy that I'm not completely sure if it applies but here goes... imagine you meet someone, it's love at first sight, you start dating, you have the highest moments in your life with this person you get engaged, you find out they hadn't been completely honest, you have the some of the lowest moments of your life, trust is an issue you realize that it's a critical moment in the relationship and a major decision has to be made whether to move forward with the marriage or not then boom! you find out your partners pregnant. Now there's an entirely new factor to consider. I know for me in this scenario I would seriously consider working through the trust issues and do whatever it takes to try and make the relationship work for the child's sake. *No my fiance is not pregnant.

Sorry if it the analogy sounds a bit silly but I am trying to make the situation I'm in understandable to everyone who keeps throwing out the term fraud. I disagree with everyone using the word "fraud." As I said before were are very much in love with each other and even though we're fighting and not on speaking terms (we wouldn't be the first couple to do this) every aspect of our relationship is just as real as any other relationship. To me fraud are those stories I hear about K1 visas strictly for papers in exchange for financial gain where there is no real relationship and that is not us!

But this is the reason why I'm here, to gather all the correct information I can so I can make an informed decision on the best way to proceed.

I love her very much! And although a relationship may or may not work out between us I want to always make sure that she's okay.

If you want to continue then that's up to you but I would caution, if they even suspect she is lying about the relationship they will deny her and her visit visa is gone too. If they even suspect her of material misrepresentation they will give her a lifetime ban.

Get her to postpone the interview, work on your relationship and then have the interview.

If this was me after a big I am not taking to my bf fight i would not be in a good place to do a visa interview. They are trained to pick up on nervousness and the interview makes even those with happy relationships feel nervous let alone those in the middle of a not talking to each other row.

But this is the reason why I'm here, to gather all the correct information I can so I can make an informed decision on the best way to proceed.

Wrong. I know 4 girls from Russia who got married and moved to US just like your fiancé, through K1 visa. All the marriages are real, I don't know anybody who were " looking for western men strictly for financial gain and green cards". And i know even more girls who got other types of visa. None of them (including me) had problems receiving US visas, including tourists, student, or any other kind. You have some weird sources of information. And by the way, being from Russia myself, i don't find it very nice of you to say things like that.

@banana_princess - Please don't shoot the messenger but I found it odd myself that every time I informed someone family, friends, coworkers, acquaintances etc. that I was engaged to a Russian girl they all told me to "be careful" and asked "does she needs papers?" Even other Russians I know in my community "warned" me!

This is actually how I found out she had been lying to me (because of all the people telling me to be careful). I ended up doing a little snooping on her phone while she was sleeping one night as she was always very 'jumpy' when her phone went off. Long story short I found out she had a boyfriend during the first three months of our relationship back in Russia she didn't disclose to me. She was also talking to several other men she met while she was in America. BUT... I also found out how much she loves me and wants to marry me and wants to start a family with me. And there in lies the "dilemma!"

So out of any of these girls you know did any of them have a previous 1-129F or K1 and didn't go through with it and still got award future visas of any kind without any problems?

Well, i guess i've been lucky to be surrounded by honest people then. And i hope you realize that it doesn't mean that all Russian girls are like that, even if there are few (i assume there are few like that from every country).

Nope, none of them applied for any other visas after K-1, because all K-1s were approved and they all live in US with their husbands. I just don't see it being a problem, really. Plans change, there are people in the embassy, not robots, and i'm sure these people have their own break up stories. Im going through AOS right now and I've read a lot of stories about that, for example sometimes people get divorced in the middle of AOS process, then the immigrant gets married again to another person and the green card gets approved through the second marriage. If both marriages are bona fide there is nothing to worry about. Same with your relationships. If they are real there will be ways to prove that if somebody gives her hard time in the future (i even doubt it will happen, but may be she will be asked a couple of questions).

The reason why people keep mentioning fraud is because you said you wanted to cancel the papers and walk away, but felt obligated to continue on due to the fact that it may hurt her chances of getting a visa later on.This is what your first post said. This is why people are saying it's fraud. I'm more of trying to explain the point rather than beat a dead horse Fraud is not just financial gain. It can be 1 sided (where the petitioner is fooled by the beneficiary to get into the U.S and then later left the petitioner), it could be two people who make a mutual agreement to have the beneficiary come to the U.S under a K1 visa but do not plan on continuing their relationship. Basically, if you're using the K1 visa for ANYTHING other than it's intended purpose...it's fraud, which is why members keep bringing it up. Now, that being said, I would highly recommend waiting to see if your relationship is strong enough to not only survive a marriage, but to pass an interview at the Russian embassy as well. There is no absolute that she'll pass the interview, and if your relationship is strained (not talking for two weeks, finding out that she has another boyfriend) I would certainly wait. The fact that she has another boyfriend will hurt her interview significantly.

You found out how much she loves you and wants to marry you and wants to start a family with you while at the same time she had a boyfriend the first three months of your relationship and was also talking to SEVERAL other men she met. If she cares for you, why would she do all those things?

Visas as emotional compensation, sounds right.

If you go through any fraudulent process just to appease her or your emotional guilt and the truth comes out, she would be kissing USA goodbye for good.
