My friend has a question and wanted me to ask for him. He's from Russia and has been here since we were in the 10th grade... He wants to marry someone from back home, he just sent off his paperwork.. He isn't on VJ (yet-I told him to create an account because this page is very helpful).... His question is, her ID and her passport both have the wrong date of birth of 10/15/1987 when her birth certificate says 3/18/1985 and that's the correct date... He was advised by the USCIS to put the date as seen on the passport and said that she would have to fix it at her interview and show them the correct documentation and said they should be able to fix this..... He states that the mix up happened with she went and got her ID and passport with her sister and they changed their information... He would like to know if that sounds about right? To sum up what's being asked would they have an issue with her interview since the information doesn't match?

Your friend can not rely on USCIS for legal help. There is no fixing it at the interview. When sending in documents, the beneficiary is attesting that they are true and do not contain false information.

Tell your friend's fiancee to go get her ID and passport fixed. That should have been done long ago. Why would you use an ID with the wrong birthday to get a passport?

I don't think it was an issue there, but now it is since they want to get married. and he wants to bring her here.

but he sent in the forms already with the DOB that's on the passport. would that be an issue?

Yeah, it will be an issue. He is knowingly using false information. That's just plain stupid. DId he not read that he was attesting that the information he provided was true when he signed the I-129f?

Fix the passport before the interview.

well they will have to figure something out because he did what the USCIS told him, and even on the paperwork say use the DOB as seen on the passport.

The passport needs to be fixed first. If they didn't and sent in the papers, it's a shame; but that doesn't change the fact the passport needs to be corrected first.

You asked and aaron2020 gave you the correct the answer. Whether your friend wants accept this answer or not, it's a whole different story.

Once again, he can not rely on USCIS for legal advice. That's the US Government's position.

If you friend relied on bad advice from USCIS and didn't check it out, then it's his responsibility for relying on that information and he's SOL.

I have the same issue.

My fiancée doesn't have a birth certificate , but an ID, and on the ID there is no month or date just the year he was born - 1993.

We had a professional fill out our I-129f petition and she put January 1,1993 as his birthday. He got a passport AFTER we sent the petition in and we tried to have the people at the passport place put January 1,1993 as his birthday but they were stubborn and said- we will put what we want.

A while after we realized they put April 1, 1993 as his birthday on the passport- differing from what USCIS had. But we were advised to just explain the situation at the embassy on interview day that it's happened before in Afghanistan because there are no birth certificates or specific dates or months on the IDs and it shouldn't be a problem.

So that's what we are doing. Hopefully same case for your friend.

It's too hard and expensive and they usually don't even allow you to get a second one here in Afghanistan (a passport) we got this one which much difficulty. If it's possible to get a passport for your friends fiancée fast and easy then obviously I suggest getting the issue fixed.

Your situation is different. IN the OP's friend's situation, the woman knows her birth date and has her birth certificate. For whatever reason (fraud or mistake), her passport has her sister's DOB.

You are asking for help and many have given you the CORRECT information(unlike the USCIS MISinformation line), yet you sit here and argue. If you don't want to help you friend go ahead and keep ignoring the accurate information that very experienced and knowledgeable members are giving you. Seriously, why even ask? AGAIN, this is something that your friend CANNOT fix at the interview. Period. End of story!!! What exactly do you think they are going to do to help someone who knowingly provided incorrect information? The answer is: a denial.

I was not arguing at all. You can't tell how someone feels by a message if I am not suing all caps... but you are entitled to your option. You are the one that's being argumentative here not myself. So if you don't have anything nice or helpful to say please keep it to yourself. I told him what they needed to do and he said he did what he was told by the USCIS and the paperwork. I had nothing to do with that, he just informed me of what was said. Since he didn't like what I told him, I created this to ask other but got the same answer as I gave him. So again please don't assume I gave him wrong information, I don't work for the USCIS! Also this was from last week so there wasn't no need for you to say anything. But again thank you for bringing your argumentative point of view
