Hello everyone I have a question regarding to our petition. Here my story...

My family is from the Philippines, year 1992 my grandfather filed a petition to my mother under F3 category along with my father and other siblings. Year 1993 our petition got approved, so our Priority date will be Dec 1993.

Year 2009 we emailed NVC regarding CSPA and the NVC told us that we are under the law, so there's nothing to worry about that, now Im already 24 the youngest in our family.

Year 2013 my grandfather died (the petitioner) then my Auntie filed to be the Substitute Sponsor to our family then the NVC approved it. But still our Priority date is not current.

Year 2015 September my Auntie died because of cancer (the substitute sponsor)

Last April 2016 finally our Priority date become current, then my other Auntie filed to be the Substitute sponsor to our family she submitted all the documents needed last May, then she called the NVC last week and the NVC said that they already recieved the documents last month and being reviewed. And also last week we submitted Ds 260 and other documents we already completed it last 2013 (civil documents etc)

How long we will wait for our visa interview to be schedule? Its been 22yrs of waiting I hope for the best for my family. ?? Please enlighten me thank you!

Year 1993 our petition got approved, so our Priority date will be Dec 1993. The PD is when the case was filed. The PD is not related to when the petition was approved.

Year 2009 we emailed NVC regarding CSPA and the NVC told us that we are under the law, so there's nothing to worry about that, now Im already 24 the youngest in our family. Sorry, but the NVC should never have told not not to worry. What may have been true in 2009 is not true in 2016. Since it took only one year to approve the I-130, you only get one year of CSPA protection after your 21st birthday. CSPA will not help you since you are 24 and have aged out. Sorry to be the bearer of bad news.

hi

also it will depend on the immigration officer if your family gets a visa at all, I have seen cases when the petitioner dies, the petition dies and the officer doesn't accept the substitute. NVC is one thing, but the officer has the last work in the decision process'

there is no guarantee at this point in time, all they can do is go to the interview and see what happens, I hope they do get their visa
