hi,

I am Australian applying for a cr-1 visa.

my medical will be in Melbourne.
my interview is scheduled for next month but i have not booked my medical as i have occasionally smoked cannabis in the past and I am worried that I still have thc in my system.

I have quit smoking and do not consume any drugs.
do the medical examiners drug test?

will I be denied if I fail even though I do not consume thc and have no other history of drug use or substance abuse?

a) they don't normally test for pot

b) even if you were a heavy smoker, it would be out of your system in 30 days

however

c) read the questions on the forms carefully. If they ask if you've ever been addicted to drugs, answer truthfully. If they ask if you've ever used drugs, again answer truthfully

worst case scenario is a year ban with drug tests.

i've never been addicted to drugs like i stated just occasional marijuana use, if they ask me I answer truthfully to my occasional use?

a year ban from what exactly?

I did my medical on Wednesday just gone, in Brisbane. Before he started anything I had to provide a urine sample (still not quite sure what that was tested for, as I didn't quite get an answer). Really the only things he asked related to drug use was have I ever used or smoked any type of drugs, what they were, (and for the record, the answer is no, never touched any kind in my life - cigarettes is it for me), if so how often, what type/s of drugs and have I ever been convicted of drug related crimes or in possession. I think because I answered no to all those questions he didn't need to elaborate, but like every doctor does told me I need to give up the smokes lol! I'm guessing maybe if you admit the use they may do a test just to make sure, but don't quote me!! Just thought I'd share what I had been asked at my medical! Good luck :)

20/04/2016 - 2nd scan date for RFE documents
09/05/2016 - Case Completed ? (Now just waiting for interview date!!!)
26/05/2016 - Received Interview letter via email, interview scheduled for 26/07/2016 ??

If they ask if you've ever used any illegal drugs the answer would be yes. You get a 1 year ban from the USA and can't get the visa for a year. They'll do some random drug tests during that year and if they're clean, you get to finally get the visa.

i called the medical center in Melbourne today and they said that they don't drug test during the exam but they take a blood test....

Federally pot is still illegal. Immigration is a federal issue.

Depends on the questions asked. Because Tac05 said they asked, have you ever smoked any drugs, the answer for you will be yes. Marijuana use is a 1 year ban with random tests over that year. If you have a clean test at the wnd if the year you can get a visa.

NOBODY knows if they are going to fail a medical or not until the end. Even though drug use is a big one for failing a medical or receiving a ban for a year like NLR stated. There are other areas of the medical that even a person who has never used before can fail. I was freaking out the whole time. Apart from the urine sample, blood test, and xray that you have to do, there is a whole lot of other stuff you have to do, such as a full physical (including genital check), medical history, immunisation's, and a psychological evaluation. Many other areas to fail a medical in! It's not a walk in, walk out kinda deal, my medical lasted 2 & 1/2 hours.

All visa medicals and what they are to do and ask, are a set standard in accordance with US Immigration. The visa approved doctors have to follow these guidelines, no matter what country you are in. I honestly would go in with an open mind, after all you have said that you have given up smoking so this might work in your favour. Also like NLR said its out of your system in 30 days. Answer the questions honestly it's about all you can do. Good luck.

Ok for some reason, its not letting me cut and paste links, but.....go to the search bar and type in failed medical, drug use medical, etc, there are plenty of posts in here on the topic or google US Immigration Visa Medical there are plenty of links there as well. I have read posts of people failing medical for all sorts of reasons on here.

As for the info I have given you...it's personal experience, I had my medical 3 days ago, I went through it and had a good conversation with the doctor on the topic of what they test for and why, and the questions they ask you. And apparently they are a lot more lenient on what they actually have to do now, not like before. Oh and you won't actually know whether you passed or failed your medical until interview, your results are in a sealed envelope that you can't open, it is for the officer at interview to look at. All I was told by the doctor when he had finished was, it all looks good, but I will have to wait on the results of the bloods and xray to finalise my report. So who knows I may not have passed mine! Like we have said to you, just be honest, you never know it could mount to nothing!
