I recently went to the states and got engaged. Prior to my engagement, I had already booked a flight which will be due in September. My fiancee wants to start the process for filing the k-1 visa but i dont know if she do it if my current visa will be canceled. I want to start the process but i really need to be present for a family trip that i've been planning for months now. Can i still fly to the US if she submitted the application next month (august)?

If you are able to travel on the ESTA or have a current B1/B2 visa then you can most definitely visit. If you do not have a visa then you are in for a hard time trying to provide evidence that your intention is to only visit and not stay on and breach the terms of your visa.

Thanks for your speedy replies. I really appreciate it. I've been worried about not being able to see her until a couple of months. I really hope this process takes a short while to get approved and everything.

I have another question, we would like to go to Alaska for our honeymoon but i've been wondering if that would a problem.

Hey

We filed our petition in January (while I was visiting the US for the holidays) and I was worried as I had a trip for his birthday in April that had been booked before our engagement.

I made sure to basically take a full copy of the petition, along with a letter from my employer advising when i was expected to return to work to try and prove I wasn't just going to stay.

I was terrified that I was going to be sent home but to be honest nobody seemed bothered at all. I'm pretty sure that as it was only the petition (not the ACTUAL DS-160 application that is filed once the petition has been approved) nothing came up on the screens to suggest that i was in the process of applying for another visa, so my ESTA was still fine for travel.

In my opinion, if you're not filing till August, and your trip is only a month later you should (I say should because obviously its at the officers' discretion) be fine.

Also, with the Alaska honeymoon (amazing idea by the way!) If I'm not mistaken, you should be fine if you fly there with it being in the US but you wouldn't be able to say drive up through Canada because if you're planning on filing for the Adjustment of Status once you are married, her leaving the country would be considered as abandoning the AOS and i do believe she wouldn't be allowed back into the US for a year, at which point you would have to start the visa application process again, this time for the K-3.

Not only would the AOS filing make it impossible to leave the confines of the USA. The K1 is a one-time entry visa. Any other visas B1/B2 will be cancelled when the K1 is entered onto the passport. Leaving the country would not be the problem but re-entering impossible due lack of visa. The K1 be applied for again, starting with i129F.

Alaska honeymoon:Sounds like a good plan as long as you fly from the US direct without stop in Canada, as mentioned before.

It would be interesting what would happen if the airline would make an unscheduled stop on foreign ground.....

I might hijack the idea of Alaska.... good luck!

Hi,

Your current visa won't be cancelled until your interview - so you should (at the border officer's discretion) be ok. I visited twice during the process. The first time was after NOA2/during NVC. The second time I had already filed the DS160, scheduled my interview and had my medical. No problems either time.

If it isn't difficult, it isn't worth it.

Thank you so much everyone for helping to set my mind at ease! I was worried that i'd have to wait for however how long the visa would take for it be approved before i could see my my fiancee because already the wait is killing me.

But valefercrs do let us know how your process goes on the 18th of this month, I am eager to hear about it!

I wish there was a way to speed up the process, does anyone know how to do that? :content:

But on a real positive side, please let know what info that i MUST have and what other document(s) need to be filed with the i-129f

Only way to speed up the process is to file as soon as possible and to get all the paperwork correct.

Hi guys!! Our interview was yesterday and it only lasted 45 seconds jaja. The officer said it looked fantastic and was the easiest case he ever had. He did not ask any questions nor asked for photos or more evidence. We are very happy.

This web site helped us so much and we want to wish the best to all the couples who are still waiting.
