I asked my lawyer if I can go ahead and apply for N400 because I am eligible to apply this August. I have heard you can just go ahead even before you receive your 10 years green card. Do you know anything about this?

I have seen a bunch of posts about it. Some mixed opinions about whether we should apply before the 10 Years GC. So I'm not sure if it's the right way to process.

Yes you can. It's supposed to kickstart the approval of the ROC. You can file 90 days before your 3 year resident anniversary.

Alrighty then ! I am eligible in july. Just make sure you make copies of your green card just in case you have to give it back for the infopass!

Yep, that's a good idea. I always make copies of everything. I would probably include documentation showing that you've filed for ROC (such as the NOA1) and a cover page explaining that the new GC hasn't been received due to backlog. We're eligible June 1st, so we better get started!

I just ran an analysis of the 8 approved June 2016 filers (there were more, but their durations weren't along the trend, so I excluded them), and the 1 approved July 2016 filer. It appears that the average processing time is 304 days, from the date of filing to the date of approval. The maximum time is 320 days and the minimum is 283 days. Using this information, we can determine when our cases will most likely be approved:

 

If you filed on 07/01/2016, expect approval around 05/01/2017

If you filed on 07/18/2016, expect approval around 05/18/2017

If you filed on 07/25/2016, expect approval around 05/25/2017

 

It's just a coincidence that the expected approval day of the month is the same day in the month of filing. This is because 304 days is also the number of days from 1 July 2016 to 30 April 2017. So basically, hold on tight guys. We should be seeing some action next month!
