July 12th still waiting

'Still waiting too. I filled since July 20th 2016 extension expire and got another extension as well as even calling them several times they keep telling me to give them two weeks, the two weeks gone in and out still waiting. Any news?

Posted

I am a July 11, 2016 VSC and I applied for the N400. Got the following email which explained at least what is going on... For those who are still waiting...

No regret to apply for N400 while pending I751 cuz it`s a wrap and hope will end up great :)

Email from VSC:

As you explained you have two (2) pending applications a Petition to Remove Conditions on Residence (Form I-751); and anApplication for Naturalization (Form N-400)

As you filed Form N-400, with Form I-751 pending, the processing of your Form I-751 has stopped.  At this time, your immigration file is currently located at the National Benefits Center (NBC).  Once the NBC has completed review your immigration file, the file will be sent to your local office for review and consideration.  At your local office both your Form I-751 and N-400 will be worked concurrently.

The Vermont Service Center cannot provide you with a completion date for your Form I-751 as the processing of your Form I-751 will resume at your N-400 interview.

Now this makes more sense for those who want to apply for N-400 while I-751 is still pending and for those who aim to be US citizen. I hope the the admin can pin this so that people can easily search this information.

So what does this mean in regards to processing times?

NBC does not have processing times for i751 or N400... so it seems we are left in limbo with no idea what time frame to expect a review.

Or worst case scenario, does this mean that once my paperwork has been reviewed by NBC then it rejoins the N400 wait list at my local field office, in which case i probably wont get called for interview until 2019?

If i withdraw my N400 will this put my i751 back on track to be reviewed sooner?

I am under increasing anxiety waiting for this paperwork to be reviewed, since i have already waited 18 months. It is affecting my personal and work life, and waiting another 12-18 months is going to be unbearable.

What happens to my i751 if i withdraw my N400, since my i751 should have been reviewed in October but has now been tagged along with my N400?

It is about what you want - if your ultimate goal is Citizenship then you are on the right track. Pull up thing sounds a bit messing it up more to me... There is an end for every process - Since this is a process do not let it affect your life... Be strong we are almost there :)

Your “worst case scenario” is probably right. NBC seems to have requisitioned your file from CSC and will send both I751 and N400 to your local office for processing. You will likely be processed at your local office’s normal rate for N400.

I understand why you'd want to do that; the problem is that trying to get your I751 back from NBC may cause even more delays...or they might even lose your file altogether... I wouldn't risk it at this point, but of course it's up to you. Also, remember that the wait time for the N400 would have started counting from the moment you received your NOA for the N400, so it wouldn't be another 18 months. (probably)

my thoughts for you dude, just be careful with your dealings don't mess yourself up in the way that immigration will start questioning your case.... If possible request for info about your case. Like I said i being waiting since 17 months.

NOA for my N400 was November 2017.

NOA for my i751 was July 2016.

my i751 was supposed to have been reviewed around October but nothing.

Problem is, my field office is only processing NOAs for N400 on June 2016.

So if NBC has moved my i751 from the office it was in about to be reviewed, to my local service office im looking at another ~18 months.

I honestly cant bear another 18 months wait, if this is the case i will file a Madamus action in the new year. By that time they will have had the i751 paperwork for 20 months which my attorney says is unreasonable enough that filing Madamus will compel them to make a decision on the i751.

I kind of worry though that filing a Madamus suit will have any negative effect on my case, when your literally filing a law suit against USCIS for being un timely, they may not appreciate it.
