Our visa is CR1. And We received NOA1 and waiting for approval.


Our question is for applying N400, Is we have to wait complete three years from the GC date or 90 days before like we do in I-751.

 

Example:
if my GC dated on 01/01/2015
Expired on 01/01/2017

 

Can we apply after 01/01/2018 or 90 days before  01/01/2018 (in the month starts from 1st October)?

@MayraTP Can you share with us what was the RFE for? Can you share with us the list of documents that you sent with your initial application? This would be really helpful to the rest of us.

Well, at fist I didn't know how to properly organize the package. I sent the application without cover letter.

Tax returs 2014/15

Electricity and gas statements in both names

Health coverage letter

Bank statements

Car insurance ....

 

In the RFE, they asked just for more evidence, they included a list of things like: mortgage or lease, affidavit, If we had saving bank accounts, if we had a child send the birth certificate.

 

I sent:

** Birth certificate of my daughter ( she was born a week before we received the RFE

** IRS tax transcripts 2014/15/16

** New helth insurance coverage card

** Affidavits of my brother in law and friend

** a letter explaining why we don't have lease, mortgage and saving bank account.

 

That was all! :)

This morning I received 5 consecutive text messages from USCIS indicating that my case was updated. 

 

Finally "New card is being produced"

 

Filled CSC (Miami)

NOA 07/05/16

no RFE, no interview 

 

I'm currently out of the country. Hopefully the CBP officer doesn't give me a hard time coming home with I551 stamp on my passport and no "NEW" green card - 

 

Next step N400 in October when I get home from vacation.

The 90 days rule applies, so you can apply in October (double check that it's exactly 90 days, because they won't accept it if it's even a day early!)

Yay! Congrats! 

I don't think they'll give you a hard time. The stamp constitutes a green card, and while they might be able to see that the new green card was sent, they'd have no way of knowing whether you'd received it. (which, technically, you haven't, even if it's sitting in your mailbox!)
