Hi friends,

apologies if this is somewhere else... haven't seen it, but doesn't mean it isn't there.

I am in the process of going through the hoops for AOS from a k1 fiancee visa.

I received a Request for Initial Evidence I-485, stating that:

"The peititioner on Form I-864, Affidavit of Support, must submit a complete Federal income tax return [here underlined in pen and written "2015"] submitted to the IRS for the most recent tax year."

I sent with my AOS package a W4 for the last three years, including 2015.

Does this mean I need to get my partner to submit to the IRS for a 1040-EZ (seeing as he as no dependents/investments for last year)? I'm trying not to file an infopass if I don't have to.

Anyone? I feel like I'm losing my mind a bit, because I didn't get from the info available when filling out the package that I had to have a 1040, but then... I've never filed taxes in the US before. :)

Found this in the instructions for affidavit of support, that I apparently TOTALLY DIDN'T EVER SEE, or if I did, I was too worn out to notice. So this means request the 1040, yes?

"Item Numbers 18.a. - 20. Federal Income Tax Return Information

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain suf cient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. "

They need either a tax return transcript or copies of all tax return forms (1040/1040EZ and schedules) sent to IRS. The easiest and best way is to get the tax return transcript from IRS online for free so that you don't have to send everything what you sent to IRS.

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

W-4 is not part of a tax return.

They need the complete copy of the most recent(2015) tax return with all forms, schedules, W-2s and/or 1099s, OR an IRS transcript, which are free and you can get online. The USC petitioner/sponsor should know what their tax return entails.

W-4 was my Canadian brain trying to say W-2, and instead naming the Canadian version. :) Regardless!
