Not received bio metrics letter after 40 days

Hi Guys,

USCIS received my application on the 27th of May. I received the NOA1 a few days later.

i-485 i-765 jointly filed

It turns out that the i-485 confirmation was addressed to next door (!), luckily I am friendly with the neighbours so I received the documentation. However after this I have not received my bio-metrics appointment letter, it has now been 40 days since my application was filed.

I have rang USCIS and they filed a service request which could take 30 days. Normally, I wouldn't be too bothered but my wife is expecting in two months which means I need to get a job ASAP. I've tried to get call backs from immigration officers but they don't seem to call back.

Any advice as to what I can do now?

you can try expedite your EAD... typically they expedite it on a job offer but also if you can show proof of financial hardship they will also consider to expedite it... due to your wife being due in 2months you could use that as proof of hardship as a way to expedite it since your wife will obviously not be working for a period of time which can become a financial strain if your EAD isnt approved in time.. just call them explain you need it expedited and explain the situation if they agree to expedite it they will probably need proof from the dr that your wife is in deeed pregnant before they approve the expedite

April 11th: Recieved at Chicago lockbox [Day 0]

April 25th: NOA1 date (never recieved e-notifications) [Day 14]

April 29th: NOA1 hard copy recieved in the mail [Day 18]

May 9th: "Fingerprint fee recieved" [Day 28]

May 12th: Reciept number's start working on USCIS case status website [Day 31]

May 20th: Biometrics letter recieved [Day 39]

June 1st: Biometric appointment [Day 51]

​November 12th: Interview letter received ​[Day 216]

December 1st: Interview day! APPROVED [Day 235]

December 5th: Case status changed from "fingerprint fee received" to "Approved" post dated Dec 1st [Day 239]

Received approval letter in the mail for Green card [Day 239]

December 6th: "Card was mailed to me" [Day 240]

December 8th: Green card received in mail!!! [day 242]

You can't get an EAD before biometrics, the biometrics is the photo and fingerprint that will go on your ead



What you can do, is as soon as you get the appointment for biometrics, try to do an early walk in and request for EAD expedite.
