5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

Hi Asamu,

Good luck on your immigration journey. From personal experience, arriving in the USA on a visitor's visa from Canada, getting married, and then applying for an AOS is legal to do. This is provided if they DID NOT come into the USA with the intention of immigration fraud by getting married here in the USA. The AOS this way worked for me (as I got my AOS approved/Green Card), but I can't say that it will work for everyone else, as every situation is different. My best advice to your and to anyone else who want to go through this route: Get your story straight, your paperwork organized and hire a good immigration lawyer.

Oh, and as quoted from my timeline: "Believe us, being harrassed at the border for 2 hours is "not a picnic in the park". There were some misunderstandings on my (Ant's) end about not having enough ties to Canada. Hence, they made me (Ant) get a Visitor's Visa for my visit to the USA, even though Canada is exempt from Visitor's Visas for short trips. Oh well, we proved them wrong unintentionally, as what originally was a two week vacation visit together in the USA ended up being an unplanned lifetime together here in the USA..."

Hope this helps. If not, then I hope it offers an insight as to another " non-traditional immigration alternative"...

Should I abandon my I129 and file an AOS?

So far I have been pursuing K3 (I129). It is still pending at the moment at CSC.

Last week, I was introduced to a fellow Canadian who only filed for AOS after waltzing into

the US on the visa waiver program. They have been approved and living happily ever after.

Now, why do most of us follow this K3 process, if an AOS is possible? For once you are don going through K3 we still have to go through AOS. I thought because I did not

have an 'A' number or a I94, I had to follow the K3. Would someone kindly make sense... for I am

praying I did not just waist time and money and will still waist more time and money when the case reaches Montreal.

For if an AOS is available - my be I should pack my bags and find the first flight out!

I'd like to add that our Immigration's Officer was actually very nice despite having to do his job. Yes, an hour and a half can seem like an eternity when you're staring down the possibility of a direct ticket back home and separation but we were nothing but respectful to the guy and he was nice in return.

He actually had been through this process with his wife so he understood what we were going through. Of course he didn't tell us that until AFTER we were free to go.. but still.

Nothing I say is legal advice. I recommend you consult a qualified immigration attorney for any questions you may have.

K-3 is for people who are outside US and want to get in US to file for AOS. As a K-3 means you are outside (or the beneficiary), entering in US on a visa pending is not for AOS as i understood the rules.

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

...-03-08 2 Welcome in America letters and green card received.

We just had this happen to us. My husband came to the States to visit. We got stopped at immigration and he almost wasn't allowed back into the country. After 1.5 hours in the office and being grilled with questions etc, he said that he was convinced my husband was just visiting and let him into the country. (I-94 in his passport no A- number) When we arrived back at my home, his I-130 approval was in the mailbox!! (Freak occurence. Especially since the website for our I-130 status wasn't updated until two weeks later!! )

It stated in the directions to file AOS (I-485). I called USCIS to confirm this is possible since he was really only visiting and they said yes. So we're filing AOS and forgetting about the I-129f.

could you tell what kind of questions those were and if your husband had to show any paperwork proving that it's just a visit? I am dying to go see my husband even for just a week, but after filing I-130 (I have a valid B1/B2), I am afraid of going to US for I am worried they will turn me back! :innocent:

Hubby was visiting me here in France, but he only has that much vacation time...

They were pretty basic actually. How long was he planning on staying, where was his return ticket. How had he entered the US before (he had a student visa before and a work visa).. had he ever been denied entry... when did we file our paperwork and had I ever filed for anybody before.

I think he literally had ALL the petition info infront of him (he said he did anyway) because he did question me about things on our applications. When did I file, where did I list my place of residence for 2000? etc. This is also another reason why I suspect he knew that our I-130 was approved (and thus giving us a hard time) even though we had no idea at the time.

Why are you loosing your mind? Was it feeling confined? Did it want to go for a walk?

Ok....maybe I didn't prove you wrong. This post might have been valuable in demonstrating why losing isn't spelled loosing...

I was grilled for quite sometime at this backwater POE in Nowhere Maine/Quebec. This was years before I even married my husband, but I think because I was in his car with him, they were suspicious. I've never experienced that before or since. We even entered the US several times together, when he was living in Canada (Michigan/Ontario border) and it was all a breeze. I think a lot of it depends on how busy a POE is and who you get to inspect you.
