Hi, how are yall doing?

So, I had some thoughts and I couldn't figure them myself. If someone knows the answers, it would be extremely helpful!

I uploaded a picture to help.

A little bit of background:

I filed a AOS using a sponsor and a joint sponsor. The joint sponsor fills the requirements and its pretty much done. The main sponsor is what is causing me the doubt.

By the time I filled the AOS, she hadn't filled any Tax Return because she was not required to. She is mainly a student and always had a side job.

Now, for the first time, she has filled the Tax Return for the 2015 tax year. Before she was claimed as a dependent by her father.

In the original submission, i had send a couple of W2s and a explanatory letter to explain why she was not required to file taxes.

The RFE came because I left 3 blank spaces on the main sponsor I-864. In the request, it asks to fill those blank spaces and submit the tax documents with supporting evidence.

My questions are:

In the form I-864, at part 6, item 18.a., it asks if you had filled a Tax Return for the three most recent tax years. Naturally I would have to mark "no" on this one.

On items 19 it asks for the year and the income. Should I fill just the 2015 and the other years just put "N/A"?

Also, should I check item 20, which says she was not required to file a Tax return?
Should I write down a letter explaining why she was not required to file? (I did this in the original submission)

Im filing an IRS Tax Transcript for the 2015 tax year. Should I look for more documents (W2s, 1099) related to the last three tax years?

Sorry if this is confusing. I've tried to explain at my best, but if it still some doubts, please don't mind asking me.

I'n not an expert in this area but I can speak from my experience with USCIS. We have received 2 RFEs related to not filed 2015 income tax return (even though I have IRS extension of time form so I assume) so will you most likely.

File 2015 taxes as soon as possible and include explanation letter why she did not have to file taxes before.

On items 19 it asks for the year and the income. Should I fill just the 2015 and the other years just put "N/A"? Correct, fill the Total Income amount, or AGI if she did a 1040EZ, and the other 2 years will be N/A.

Also, should I check item 20, which says she was not required to file a Tax return?

Should I write down a letter explaining why she was not required to file? (I did this in the original submission) Yes. You need a statement to explain why she was not legally required to file taxes those years. If she was not working and had no income, then that is a valid reason.

KayDeeCee, for the third time, thanks a whole lot!!

I've ordered a "Verification of Nonfilling" using the 4506-T form but till now I haven't received an answer from the IRS folks.

If I may ask one last question, do you think that will be necessary or just a signed statement will do?

Again, I appreciate all the help you and all the folks from this site are giving to me!
