Help!!!

My brother went to his visa interview yesterday to attend my wedding in October. Unfortunately he got denied. The reason was : " Your sister mis used her Visa in the US"

I am confused. I already got an update on my case Sept 6 that I am scheduled for an interview, I sent my packet in July 14 and it was received July 18th on the form.

I adjusted my status here in the States in 2014 From B2 to F1 and now GC because I got married in June. Technically I am out of dt status as I am waiting for the approvals for my permanent residency..

I am scared amd confused. cried all night... I miss my family so much! Will this affect me? My mom will be interview on Monday and they also got her name yesterday will that affect her too?

Don't wanna say this but changing visa type while in the US can cause a lot more than you believe. I've heard more than hundred times about how people got denied tourist visa due to this matter. I had a friend who was here on J1 then tried to extend her stay by changing it to B2 and later married American man. She got pregnant and want her mom to visit her during her giving birth period as the husband need to go work abroad during the time. She provided every sponsor letter, all medical document from the doctor and everything. Her mom got denied. But anyway different consular might have different view. Hope your family could get a visa.

14 August 2015 : Mailed I-129F through USPS express service

02 September 2015 : Received NOA1 hard copy by mail.

05 October 2015 : Case number was assigned.

20 October 2015 : Packet 3 arrived in my hand.

03 November 2015 : Got Packet 4 e-mail from Bangkok embassy about the interview date.

18 November 2015 : Visa interview and it was approved!

20 November 2015 : Got documents and a passport with K1 Visa back in my hands

A quick update on my case:

My EAD status got updated today to “card is being produced” (NOA dated July 14). I understand that from there it has taken few (4-5) business days for some to get the EAD card in the mail, and several weeks for others. I also understand that the status will change to "card was approved” and then “card was mailed”. As recommended by one poster I registered to USPS free service to receive notification of tracked mails sent to my address.

My AOS status remains at “RFE response has been received and USCIS started working on your case again”. NOA on AOS is also July 14

It would help, if you could tell us a bit more about your timeline. I also applied for GC from F-1. Did you get married while your F-1 visa was still valid? If so, did you remain enrolled in school after you sent AOS? If you didn't, it will

show USCIS that you breached your visa status. I know technically you do not have to be enrolled in classes once married, but it is definitely recommended since you came here to study. A friend of

mine was also on an F-1 visa, got married and dropped school once the AOS was mailed. The case officer asked her if she was still studying as it says she breached the visa conditions. However, it did not have an impact on

her GC approval. Your GC is not approved though and if you are not on a valid F-1 visa anymore, I can understand that they would deny your family entry. If you want your family there, I would suggest to postpone your wedding

until you have your greencard since you are already married anyway.

April 11th: Recieved at Chicago lockbox [Day 0]

April 25th: NOA1 date (never recieved e-notifications) [Day 14]

April 29th: NOA1 hard copy recieved in the mail [Day 18]

May 9th: "Fingerprint fee recieved" [Day 28]

May 12th: Reciept number's start working on USCIS case status website [Day 31]

May 20th: Biometrics letter recieved [Day 39]

June 1st: Biometric appointment [Day 51]

​November 12th: Interview letter received ​[Day 216]

December 1st: Interview day! APPROVED [Day 235]

December 5th: Case status changed from "fingerprint fee received" to "Approved" post dated Dec 1st [Day 239]

Received approval letter in the mail for Green card [Day 239]

December 6th: "Card was mailed to me" [Day 240]

December 8th: Green card received in mail!!! [day 242]

I believe it depends on the consul.. Did your spouse helped with their paperworks as well?

It does! Because my bff whose also my Bridesmaid, went to have her interview and she got 10yrs Multiple entry. I was her sponsor too, I sent her letters and invitations and intinerary and stuff same thing I did for my Brother... My Mom will have her interview this Monday I doubt she gets approved at this point... ? lol my eyes hurt from crying. Never thought it will affect me this much. I was so confident bec my beatfriend made it..

I came here on B2, adjusted my status to F1 while still in status, I was a full time student for one year. I did not re-enroll for Sept. classes (fall 2015) as we were already to get married anyway. June we got married and submitted all my papers in July. My status said " as of Sept 6, ready to be scheduled for interview" however AP/EAD still showing case is recieveda July 18.

We cant postpone our wedding anymore bec its 3 weeks away and we already have paid most of it.

It is really sad, my brother was supposed to walk me down..? My father is not around.

I hope this doesnt happen to my Mother on Monday and I really hope more importantly this doesnt affect my GC. It will really break me apart as all of us JULY filers are getting close to the finish line (for now til we renew our GC to permanent or apply for citizenship)

Yes I was still in status when I changed from B2 to F1 and went to school full time for a year. But didn't enroll after that because we were to get married anyway, so technically I was out of status before marriage ? Right now my case is ready to be scheduled for interview as of Sept 6. I am scared that my brothers denial will affect my GC aplication.. What do you think? Also scared that everyone in my family will never get to see me on my wedding. My bestfriend from the Phils also is coming bec she is my bridesmaid, I also sponsored her and gave her the same document and necessary stuff on her interview and she got approved 10yrs Multiple, the consul asked her how long have we been friends, she answered 12 yrs and the consul even said enjoy the wedding!

I am soooo sad and scared at the same time...

Felicitations a vous! J'ai recu mon NOA deux jours avant le votre, alors j'espere recevoir un quelconque feedback d'ici peu. Peut etre la semaine prochaine. Ca me tue de rester a la maison sans rien faire.

Maybe your brother could try again but youre gonna pay another fee. Theres a rule in the embassy that a person cannot have the same consul who rejected them for the next application of their visa.

if you submitted your aos while being currently in status then it shouldnt of impacted there interview... were you out of status at a b2 when you filed you f1?

Yes I was still in status when I changed from B2 to F1 and went to school full time for a year. But didn't enroll after that because we were to get married anyway, so technically I was out of status before marriage ? Right now my case is ready to be scheduled for interview as of Sept 6. Went to the DMV last week to get my learner's permit to start practicing for my license and they said I couldn't get it without proof from USCIS that I was here legally. Will the EAD be enough proof or will I have to wait till I have the green card in hand? I really want to start driving soon.

EAD is enought proof. However if you're in CA, even if you're out of status you can get a driver's license.

11/03/2016: We had out interview in Los Angeles CA. Our IO said they don't normally approve on the spot anymore and she gave us a paper saying "your case is being held for interview". The IO also said she is new, therefore she need to talk to her supervisor. Additionally she showed us a pile of cases that is being held for review, so it looks like it will take a while to get an answer about our case.

11/07/2016: EAD card was mailed to me

11/09/2016: EAD card received. Applied for SSN, needs verification will take up to 4 weeks.

11/10/2016: went back to SSA office with my unexpired passport, got verified right away.

11/10/2016: SSN card received

12/28/2016: I-485 status updated to "New Card Being Produced",later in the day updated to "Case was approved"; I-130 status updated to "Case approved"

(1 month, 3 weeks & 4 days after the interview) & (5 months & 2 days after filing AOS)

1/03/2016: Receive I-797 approval letter for I-130 & I-485; status updated to "New Card Being Produced"

1/04/2016: Welcome letter received; status updated to "Card was Mailed"

1/06/2017: 2 year green card received :D
