Hello everyone,

Yesterday I received a Request for Initial Evidence for my I-485 for the following reasons:

- Petitioner/sponsor lists their current income on Form I-864 as an amount considered as sufficient; however no evidence has been submitted as proof of current income. Submit evidence of the petitioner/sponsor's current income such as:

Hello everyone,

Yesterday I received a Request for Initial Evidence for my I-485 for the following reasons:

1. Petitioner/sponsor lists their current income on Form I-864 as an amount considered as sufficient; however no evidence has been submitted as proof of current income. Submit evidence of the petitioner/sponsor's current income such as:

-Pay stubs or documentation of pay for previous 6 months

-Evidence of other income (goes on to list pension, annuities etc which doesn't apply to us)

-Letter of employment containing the following:

  • Dates of employment
  • Nature of job
  • Yearly salary
  • Number of hours per week worked
  • Prospects of future employment or advancement

2. Submit all supporting tax documentation (W-2s, 1099s, etc) submitted to the IRS for the most recent tax year. The petitioner/sponsor must submit all supporting tax documents for the most recent tax year

3. Based on the documents submitted with Form I-864, the income did not meet 125% of the poverty guidelines for the petitioner/sponsor household size. Submit evidence of assets that meet the standards listed below or obtain a joint sponsor:

So a little bit about our background:

My spouse (USC) is starting her employment in November, and has an offer/contract letter detailing her position and salary (~$90,000) in a healthcare-related field which we originally submitted with our application. We were both full-time students in grad school for the past 3 years and my wife's tax transcript for 2015 shows AGI of $18,675 (from student jobs) which we also submitted with our initial application. She doesn't start work until November so we don't have pay stubs or any other proof of income beyond what is on her 2015 IRS return. I am in a similar field, and will be earning a similar salary and my employment starts Sep 1 (this week!) and I have an individual IRS 2015 return with AGI of ~$40,000 (from student jobs) but I'm not sure if that makes any difference. FYI I did not submit evidence of my income to USCIS with our I-485 application.

We submitted the following with our original I-864:

-My spouse's (USC) offer letter of employment from her company's HR dept stating position, hours, salary and start date of November 1

-Spouse's tax returns for 2015 ($18675), 2014 ($1580), 2012 ($2530)

My question is: What should we submit now? Should we re-submit my wife's original employment letter with evidence of salary and write a cover letter saying that we don't have any pay stubs right now but will have some by the time we are approved or scheduled for an interview (which for our field office is 6-8 months later)? And/or submit my (beneficiary) prior year tax return and evidence of job? Or get a joint sponsor? It frustrates me that we have evidence of income but that it is not good enough since we have not yet started our employment. Any help or advice would be appreciated. Thanks!

Better to find a joint sponsor. it won't do you guys any good to send proof of your upcoming jobs since none of them started already and also you won't be there long enough to show stability.

I believe you need to find a co sponsor since you and wife just start the job and the tax return last year is not sufficient. I was like you got a job last November but I also include 6 months recent pay tubs + my parent co sponsor. So I don't have any problem with that. Good luck

Thanks for your speedy response, p-ana and ken88. Yes I suppose getting a joint sponsor is the last resort... My spouse will have to ask her parents then to be a co-sponsor correct? So does my in-law (USC) submit a I-864 along with tax return and US passport? Does my spouse need to re-submit any documents, or do we just send in a packet with the RFIE and joint sponsor's I-864 and supporting evidence of income?

Thanks for your speedy response, p-ana and ken88. Yes I suppose getting a joint sponsor is the last resort... My spouse will have to ask her parents then to be a co-sponsor correct? So does my in-law (USC) submit a I-864 along with tax return and US passport? I think you better send a RFIE along with a cover letter include joint sponsor either parents or a USC plus all the pay stubs. But parents co sponsor make it look a little better.

We have the same timeline as yours and in my case, I did file 3 years of tax. In 2015 we had a business loss, 2014 and 2013 were way over the requirement.

For 2016, we include paystubs for the first 6 months.

So to prevent RFIE, we provide proof of assets (banks account, IRA accounts, etc).

Co sponsor is the easiest way to satisfy this RFIE

7/18: Mailed packages to Chicago lockbox

7/19: Received by USCIS

7/26: Received 8 text/email NOAs

7/27: Checks cashed
7/30: Received 8 hard copy NOAs

8/6: Bio letter received

9/10: Case updated that RFIE was mailed regarding i485

9/17: Received RFIE (needs a cosponsor)

9/23: Mailed back RFIE

9/27: Case update: RFIE received by USCIS and case resumed

10/3: Created SR for my EAD as it's been 75 days.

10/14: Contacted congressman office to inquiry/expedite

10/19: EAD card ordered, AP approved

Got back from a week vacay with hubby just opened my rfe letter. It says:

The petitioner/sponsor on I-864, Affidavit of Support , must submit a complete Federal income tax return submitted to the Internal Revenue Service (IRS) for the most recent tax year.

Then there's a hand written note that says: 2015-1040

We must have overlooked this... We just need the 1040 form for 2015

Just got back from getting my biometrics done! The man at the Pittsburgh office that did my biometrics was so lovely! He even let me take my picture a few times until I was happy with it!

My case numbers MSC16913096xx don't work I tried a few either side and they don't work either......maybe one day soon!!!!

My case number is MSC1691310xxx dated 8th July.

It is not seen in the system as of now and also no biometrics letter.

I've booked an infopass appointment to find out what's going on withe my case, I spoke to a guy from USCIS on the phone today who was really nice he was very chatty and he tried all my case numbers and stated they still didn't work for him either, he said the best thing to do is go for the infopass appointment and go from there. He did say I might have to reapply with my NOA1 notifications so I don't pay again but he thinks my file has possibly been held up somewhere, it was nice to chat to someone who was nice and made the time to listen to my concerns.

I'll let you all know how I get on or if I hear anything else soon!

NOA dated 8th July from Detroit.

No Biometrics letter so far.

Case not appearing on the system so far.

No clear response from Service Centers

Going for Infopass on 31st. Will update

It seems USCIS had not uploaded in their system a bunch of applicatikns, after the receipt notice was issued.

Thats why they were neither appearing on the case status webpage, nor biometrics letters were issued.

Now all fixed. Biometrics letters are on the way, but it may take some time before their website shows the status.

At least no need to refile

Currently awaiting a call back from tier 2 about my case, tier one guy wasn't very helpful and just wanted to put a service request in again. I'm just curious to see if my case like -nkgeicher has been put in the system yet and if I can find out if I have a biometrics appointment scheduled soon or not.

I'll let you know how I get on.
