Hello i have a RFE for i864 to which I am sending of today.. however i have a few questions..

Do i tick the box on page 6 part 6 question 17.. which says one or more of the people listen in item numbers 3..6..9.. and 12 do not need to complete form i864a because he or she is the intending immigrant and has no accompanying dependants then it asks for the name underneath.. My wife has no dependants and i am not joint sponsoring her so was wondering do i tick this? and write her name?

Also my third year of most recent tax was half of my usual pay as i only started work half way through the year.. do i need to state why that tax is under the poverty guideline? my rest of the tax years is above and fine.

Have you listed her name anywhere in 3..6..9..and 12? If not, don't check and don't write her name. If yes, then check and write her name.

While not necessary, doesn't hurt to state.

I put her name on the information about the principle immigrant which im not sure if that would class?

In simple terms, are you combining her income into yours? If not, don't check and don't put her name.

If you are not using the income or assets from the immigrant, then they will not be listed in Part 6 and you do not check the box for #17.

Your current annual income is what matters. That is something separate from the last 3 years of tax info you list in another part of the form. Your past incomes do not need to meet the requirement, you current income does. You do not need to provide an explanation as to why you did not meet the requirement 3 or 4 years ago.

Providing basic info about where you are in the process can help people answer your concerns better. Fill out your timeline or at least state what process you are in when posting. I am assuming you are adjusting status from a K-1.
