Timeline

People have been denied after returning an RFE response, however they still will send you a denial notice. If you don't hear a response within the 90 day time period they give then I would put in an inquiry with USCIS.

Just got notice from the embassy in Casablanca that habibi's interview will be Nov 7th!!

I'm nearly in tears at work trying to process this mentally. Called habibi even though it's only 2pm his time to tell him the good news and he's just as speechless.

We were notified about the Rfe on 09/30 then we received the letter on 6/10 and sent the answer on 7/10.

We haven't seen anything yet on the app. It still shows Rfe mailed...sour we are still waiting.

But wonder if there are some people that got denied after an RFE was sent...? Just being curious, negative ...Haha.

It took one week for me to get the "we've received your response" from them. So you will probably get the received response by the end of this week. Then it took another week to get the NOA2. I think you are still within the 'normal' time frame so don't worry too much.. still, the wait is always frustrating.

I am freaking out.... Since I am not getting my NVC number and it is going past three weeks and they say my case has not arrived I decided to take a closer look at my NOA2. It says "your case was forwarded to the listed consulate"... when we did this last time it said our case was forwarded to the NVC and would be processed and I would hear from them... now it says it was forwarded to the "listed consulate"... only THERE IS NO CONSULATE LISTED!!! no country.. nothing!!! and NO INSTRUCTIONS... I called the USCIS and they said they can only see what I see and there is nothing they can do. They said it can take up to 60 days for my file to "transfer"... OMG... I can't believe this... I don't know what to do.. I don't have any case number... This is my second time applying for the same fiance.. is my case number the same as last time? HELP!!!!

I think all the NOA2 hard copies say this. This also happened to someone else on here, Kay&Epi I believe. She just kept calling the NVC and got her case number last week. But I have no idea what the protocol on applying twice for the same fiance is. Were you guys denied the first time and you waited the year to reapply?

Mine says that it was forwarded to the NVC so mine is the standard NOA2 they always send and I plan to call again tonight to try and get my number.

Can you type out the full NOA 2 information? There was someone approved on 9/15 that had the same wording but their case still had a quick stop at the NVC. Don't include the personal info obviously, just what your NOA 2 says exactly the full thing.

But I have no idea what the protocol on applying twice for the same fiance is. Were you guys denied the first time and you waited the year to reapply?

Oh... ok.. my first NOA2 hardcopy did not say this... it said sent to NVC center for processing.. so that makes me feel better if maybe some do say this... no we were approved through the entire process .. and he came here.. but had a terrible family emergency right after coming.. his brothers were it a horrible auto accident...and he had to return immediately before we could marry.. so we had to do the entire thing over again....

oh gosh, that's so awful. I'm surprised he wasn't able to get an emergency advanced parole, or whatever that's called... but yeah, you should still have a stop at the NVC. I guess the only other option is for your fiance to reach out to his Embassy, and see if they have any record, but the problem is without a case number the embassy's not going to be able to find anything...

Sure.. it says "The above petition has been approved, and forwarded to the listed consulate. It has been noted this is your second approved I-129F petition and as such, your information has been entered in a multiple visa petition tracking database. Please contact the consulate with any questions about visa issuance, or if you would like them to forward the petition to a different consulate. The petitioner can also file form I-324, Application for Action of An Approved Application or Petition, to request that we notify another consulate of the petition approval for visa processing purposes.

Then it goes on to say "when the person this petition is for enters the U.S. they must marry within 90 days.. etc...

But like i said.. there is no consulate listed

So from the wording it sounds like they sent it to the same consulate as your last approved one and they have the same case number. If possible I would have your beneficiary call their local embassy to see if it is there.

I wouldn't worry about the Non-Immigrant part, according to the USCIS they are considered non-immigrant since there is a chance you may return home and not adjust status. NVC updates it for the embassy to reflect that it is an immigrant visa... its just a weird things with K-1 that have been confirmed by multiple previous approved peeps.

So from the wording it sounds like they sent it to the same consulate as your last approved one and they have the same case number. If possible I would have your beneficiary call their local embassy to see if it is there.

I wouldn't worry about the Non-Immigrant part, according to the USCIS they are considered non-immigrant since there is a chance you may return home and not adjust status. NVC updates it for the embassy to reflect that it is an immigrant visa... its just a weird things with K-1 that have been confirmed by multiple previous approved peeps.

This is what I thought... Tasha reapplied for the same fiance too. I'm going to try to contact her to see if her NVC case number is also the same. I'll have him call the consulate in India tomorrow. ugh.

Hmm. I entered my old case number into the NVC website and is says that visa was issued.. so I think maybe it's not the same case number... I don't know.. I'll keep looking into it.. otherwise I guess I will just have to wait I don't know what else to do.. I'll call NVC again tonight and see if they received it. I am so discouraged.. this entire process of trying to get married for the past year has been so defeating... :( I miss him a lot.
