Hi,

Hope someone can help.

I am the petitioner of a K1 visa and I am gonna have my interview in London on the 15th of December.

My case is slightly different as I meet my fiancé here in London and we decide to get married in California and relocate there.

My concern is about the affidativ of support, as he has been living in London for the past 15 years and worked at BBC for the past 5 making good money as a solution architect in IT , he doesn't have any tax report in Us or any other proof of income as he will go there with no job and looking for one but lots of saving which are into a uk bank account.

Anybody else in a similar situation can advise what to bring as affidativ of support?

Many thanks for your help

Hi Bice7,

You mean you are the Beneficiary, right? if you are the one having the interview...

In any case.. if your American fiance was working in London for the past 5 years he still should have been paying US taxes. I lived and worked overseas and it was still required to pay a portion back to the U.S. as an American citizen. So, as long as he did this then he will have a tax record as proof of is income earning level/salary. Also, he should have had to pay a portion of local tax as well.. and can show that as proof of past salary/income or potential to earn.

You may want to check or pay an immigration attorney to help you with just this one aspect of your application. I have used one in the past and they are very helpful.

I am no expert however, perhaps someone else has more experience with this situation...

Yes, CRamak explained very well about finances and taxes, the American citizen needs to pay or at least declare taxes doesn't matter living in another country, savings and assets may help too but it needs to be substantial, much more than a regular income

Guys.. one more quick question... I THINK I remember the last time we applied that the CO took the I-134 that I signed and kept it as part of our file. I was there for the interview and he asked me directly for it and I handed it to him.

This time the CO took it, looked at it, and handed it back to my fiance. (He did not remember the guy is supposed to take it so he thought this was supposed to happen.) Then conducted the interview. He took the rest of the items (medical report, DS-160 Payment Confirmation, Passport Photos, etc) But not the I-134 Financial Affidavit. They are supposed to take this, right? My concern is if we hand in our additional "relationship proof" they will now say our file is now complete because this is missing.

If they are supposed to take it then I am going to include it with my relationship proof with another cover letter explaining this to complete our file. I honestly believe this CO was trying to ruin this for us if this was supposed to be included as well.

They kept mine. I'd say to be on the safe side, submit it with the new info you're about to send in, but add an explanation of why it's included. Much easier for them to set it aside if they don't need it than if they need it and it's not there. At this point I'd cross all my t's and dot all my i's.

I'm glad you thought of it. That person who handed it back to your fiance possibly made a mistake, one that you'd end up paying for I'm sure, considering all the hoops you two are having to jump through.

Good luck!

Now that I think of it... the CO may have handed it back in order to sabotage you both. Well, maybe not "sabotage" exactly, but maybe "let's see just how much they're paying attention... if they want this, they'll get it right..."

I swear I'm not a conspiracy theorist, but this situation is certainly making me feel like one, haha!

Yeah, Allison, me too. <_< Ok, I was just double checking. I thought it was supposed to be handed in with the other items. Why would he only hand this one back? I'll add it in with an explanation. Thanks guys!
