B2 Visa Entitlements

A B2 visa usually allows the holder to remain in the US for a maximum of six (6) months while some B2 visa holders may be granted a stay of up to one year. A B2 visa holder may be entitled to undertake short-term study during their stay but are prohibited from engaging in employment or long-term study. In certain circumstances, B2 visa holders may be able to change their visa status while in the United States to engage in employment or full-time study.

most think 180 days as some months have 31 days and this shortens the 6 month time / in truth you should plan for her to return a little ahead of the 6 months to allow for weather / plane delays / a friend of mine was booked on Air France and the pilots went on strike and affected her return / she had to make a trip of 16 hours to embassy in DC as she could not get an info pass fast enough not to be in overstay and the airlines was not much help rebooking

Please don't book a ticket until she is approved for a tourist visa.

no worries, we did that before my wife's then fiancée's visa was ready because it was promised to me personally by the consulate that it would be ready by a certain date. Fortunately I was able to work with Delta Airlines and to get our flights pushed out by a week, I almost had to return to the US without my wife then fiancee and buy her another ticket. We will not make that mistake again. And just because we were able to work it out, I tell people not to do it, because it is a judgement call by the person you talk to and most if 90% or more refuse to budge and you get to buy another ticket.

They flew in through Chicago O'Hare

Thanks, We were thinking of selecting ORD (Chicago O'hare)as the point of Immigration or either DEN (Denver). Chicago is my first choice, because of where we are in Ohio once she goes through customs and switches planes it is only another 1 hr and 45 minutes to DAY (Dayton)

Thanks, We talked and once it is approved and book the flights we will book her departure to leave 5 - 7 days earlier than six months or 180 days.

Visa first. I do wonder about having a MIL coming to stay for 6 months....

Also look into the cost and availability of travel insurance for such a long stay.

Yeah I know having someone live with you for six months is challenging as it is, being MIL makes it even more challenging. Yeah MIL is getting all of her medical taken care of before coming, hopefully she will not have any needs while here.

I think Boiler was referring to the challenges like 2 of her children here, semi retired, new grandchild, family here to support and take care of her for so many months, etc. Rings a bit of intent to immigrate.

I was thinking the same as it is a red flag, and going to challenge her proof of intent to return.

I see. Sister in-law will not be here or have a visa yet when she applies. She is a school teacher finishing her masters degree and just now interviewing with schools here. If a school hires her through an agency approved by the state department she will get an expedited work visa.

We have documents showing she is financially secure and that she has strong ties back home, MIL has stated several times to us she does not want to immigrate here, her church and most of her children are in one area of Philippines. I think if she gets questioned during interview or when she enters they will see she does not intend to stay longer than six months. MIL even said she would prefer to stay shorter but since we are paying the way she will stay six months no more.

MIL only agreed to let us pay her way as part of pay for managing my wifes boarding house back in Philippines. we have put together letters to such for her visa interview.

If anyone here has experience in what she will need for proof as to intent to return to Philippines please feel free to suggest openly or my PM

Will this letter for her visa interview also mention that you have a baby and your wife is returning to her nursing career?

Please bear in mind that caring for grandchildren is considered work for immigration purposes. And therefore not permitted on tourist visas.
